E.J. PINTO RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-122-88 be received for information. 1. BACKGROUND: 1.1 At the General Purpose and Administration Committee of March 21, 1988, the Committee considered Planning Report PD-65-88 in respect of concerns expressed by Dr. Pinto with respect to the zoning of various lands located in Part Lot 25, Concession 1, geographic Township of Darlington. In that regard, the matter was tabled and direction provided that, Staff review the concerns expressed by Dr. Pinto and report back to the General Purpose and Administration Committee. 2. COMMENTS: 2.1 As the Committee members may recall, Dr. Pinto's concerns related to the extent of industrial zoned land north of Baseline Road and requested the Town consider an amendment to the Zoning By-law to restore the northerly . . .2 go) ~ REPORT N0. : PD-I22-88 PAGE 2 _______________________________________________________________________________ limit of the Industrial zone to that previously permitted by By-law 2111 of the former Township of Darlington. Staff noted in our earlier report that the boundary contained within By-law 84-63 (Attachment l) implemented the designation of the Durham Regional official Plan as approved in 1976 (Attachment 2) . Scaling of the Durham Regional Official Plan indicates that the northerly limit of the area designated for industrial development is approximately 985 feet north of Baseline Road. 3.3 The previous Zoning 8y-law in effect for this area was By-law 2I1I of the former Township of Darlington. Said by-law indicated the northerly boundary, for the industrial zone, some 600 feet north of Baseline Road (Attachment 3) . Dr. Pinto and a number of other area residents have indicated that they would prefer the limits and boundaries identified in the old zoning by-law and are encouraging Council to oquaidez such an amendment. 2.3 At the previous meeting, Staff had indicated that such an amendment would be difficult to achieve without the consent of the land owner affected. In that regard, on March 28' 1988, Staff met with Mr. Biokle, the nvnzer of the lands in question, to discuss this issue. Mc. Bicble indicated that be was well aware of the Official Plan designation and the changes brought about by By-law 84-63, and did not support an amendment to the B y-law to reduce the amount of land / presently zoned for industrial purposes. 2.4 Staff note that when the Comprehensive Zoning By-law was introduced in 1984, the purpose of said by-law was to consolidate the four (4) existing Zoning By-laws of the former municipalities and to bring same into conformity with the Durham Regional official Plan. It was during this process that the new zone boundaries were delineated to coincide with the Regional Official Plan boundaries. The delineation of the Industrial zone north of Baseline Road within By-law 84-63 does comply with the Region's Official Plan and is therefore valid.
