OF CLARKE FILES: OPA 88-20/D & DEV 88-26 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-115-88 be received; and 2. THAT the applications to amend the Durham Regional Official Plan and the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Harrington and Hoyle Limited on behalf of Canada Building Materials to develop a 83.9 hectare parcel of land for mineral aggregate extraction, located in Part Lots 29, 30 & 31, Concession 10, geographic Township of Clarke, be referred back to Staff for a subsequent report pending Staff's receipt of all comments from outside agencies; and 3. THAT the applicant's agent be so advised. 1. BACKGROUND: 1.1 On March 10, 1988, the Planning Department received an application from Harrington and Hoyle Limited, submitted on behalf of Canada Building Materials, a subsidary of St. Mary's Cement Corporation, to amend By-law 84- 63. Subsequently, on March 28, 1988, the Town was advised by the Regional . . .2 REPORT NO. : DD-115-88 PAGE 2 __--_-__--_--__________-______-___-___-_____________________________________-_- Planning Department of an application submitted by Harrington and Hoyle Limited to amend the Durham Regional official Plan. 1.2 The subject applications seek to develop 83.9 hectare (207.3 acres) of land to allow aggregate extraction, processing, stockpiling and the shipping of sand and gravel products, in Part of Lots 29, 30 6 31, Concession 10, former TonoobiB of Clarke. Staff would further note for Committee's information that a preliminary site plan was also submitted to indicate the future rehabilitation process to occur once the mineral extraction has been exhausted. (see attachment hereto) 3. COMMENTS: 2.1 The subject lands are currently designated as "Major Open Space - Oak Ridges Moraine" in the Durham Regional official Plan. The predominant use of lands so designated abaII be for agricultural and farm-related uses. In addition, conservation and similar uses such as reforestation, cemeteries, gardens, nurseries and other recreational ooea are permitted provided they are recognized within the local municipality's Zoning By-law and provided the ooeo are compatible with their surroundings. 2.2 Within 8y-law 84-63" as amended, the subject lands are zoned as "Agricultural (&)x. The predominant use of lands so zoned shall be for agricultural and farm-related uses. Staff would note that the subject lands would be rezoned to "Extractive Industrial (M3)n to recognize the extractive industry accordingly. 2.3 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate aiguage acknowledging the application was installed on the subject lands. . . .3 | REPORT 0O. : PD-115-88 P&QD 3 _______________________________________________________________________________ 3.4 In accordance with departmental procedures, the subject applications were circulated to obtain comments from other departments and agencies. The following departments/agencies offered no objection to the proposal: - ]Yzwu of Newcastle Fire Department - Town of Newcastle Building Department - Town of Newcastle Community Services Department - Regional 8eoItb Services Department - ministry of Agriculture and Food 2.5 The Town of Newcastle Public Works Department offered no objection subject to a number of conditions and further conditional upon the . Owners meet all the requirements of the Department, financial and otherwise. 2.6 The Gauoraakm Region Conservation Authority offered no objection the proposed rezoning with the exception of the proposed rehabilitation of the site. In m letter dated April 5, 1988 to the Ministry of Natural Resources, the Conservation Authority requested that the Ministry investigate or cause to be investigated the possible effects on groundwater levels resulting from surface evaporation from the proposed lake. In that regard, should such evapoocatiou be deemed to have negative effects on ground water levels, Authority Staff suggests appropriate requirements in the licensing procedure to eliminate or minimize ground water upon completion of the aggregate removal operation together with the appropriate cevegatioo. 3.7 The Ministry of Natural Resources offered no objection to the proposal provided that the "Extractive Industrial (M3)n zoning conforms to the i / licensed boundaries of the grovel pit. Staff would note for the Committee's information that the applicants n0ot submit an application to the Ministry pursuant to the Pits and Quarries Control Act in order to obtain a license. In that regard, Ministry Staff would confirm that Harrington and Hoyle Limited have submitted the application to Ministry of Natural Resources and the application is currently | / undergoing the circulation process. REPORT 00. : PD-115-88 PAGE 4 _______________________________________________________________________________ 2.8 Staff would note the oonmm'ota have not been received from Ministry of the Environment and Regional Works Department. Given that the main anoeoa will be on Regional Road 30' it is important that Staff receive comments from the Regional Works. Furthermore, Ministry of the Environment is responsible for minimizing environmental impacts such as surface and ground water impacts, noise and vibration, air quality, incompatible or conflicting land uses, site drainage and soil contamination. Given this, Staff must be in receipt of the Ministry's comments before a recommendation can be considered. 3.9 PImuuiog Staff have conducted a site investigation of the subject lands and have noted that the lands to the north, in the Township of Maovers, as well as at the east and west of the proposed site are also used for aggregate extraction.
