OF DARLINGTON OUR FILE: DEV 88-25 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-107-88 be received; and 2. THAT the rezoning application submitted by Ford Canning to rezone a parcel, located in Part Lots 29/30, Concession 1, former Twp. of Darlington, to permit the construction of a church and ancillary uses be referred back to Staff in order to permit the applicant and the Ministry of Agriculture and Food Staff the opportunity to discuss the Ministry comments in consideration of the site plan as recently submitted, and to permit Town Staff the opportunity to review outstanding comments from the Regional Works Department pertaining to the proposal, specifically access thereto; and 3. THAT the applicant be so advised. BACKGROUND AND COMMENTS: On March 9, 1988, the Planning Department received a rezoning application from Mr_ . Ford Canning, acting as the agent for Ellen Ormiston, to rezone a 2.83 ha parcel of . . .2 A00 'I U REPORT NO. : PD-107-88 PAGE 2 -------------------------------------------------------------------------------- land located in Part Lots 29/30, Concession 1, former Township of Darlington. The subject application would allow a church as well as ancillary uses such as an educational wing with classrooms, office, space, recreational room (gymnasium) and a main sanctuary. The subject parcel is designated "General Agricultural Areas" within the Durham Regional Official Plan. Section 11.2.4 states that the predominant use of lands so designated shall be for agricultural and farm related uses. However, Section 6.2.6 states: "Notwithstanding any other provisions in this Plan to the contrary, the Council of the respective area municipality may recognize in the restricted area zoning by-law, police stations, fire stations, public museums and places of worship in any area, having first been satisfied that the proposed facility is compatible with its surroundings. In determining land use compatibility, the Council of the respective area municipality shall have due regard for the provisions of this plan as they apply to the land use designation for the area in which the facility is to be located. In particular, facilities which would unduly restrict or conflict with the predominant permitted land use shall not be encouraged." Within Zoning By-law 84-63, as amended, the subject lands are zoned as "Agricultural (A)". This zone does permit cemeteries and places of worship which exist prior to the date of passing of By-law 84-63. Staff would note for the Committee's information that pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. Staff would note the following departments/agencies, in providing comments, offered no objections to the application as filed: Town of Newcastle Fire Department Town of Newcastle Building Department The Town of Newcastle Public Works Department offered no objection provided the Owner provides a Lot Grading Plan satisfactory to the Director of Public Works. . . .3 REPORT 00. : PD-107-88 PAGE 3 ------------------------------------------------------------------------------- The Regional BenItb Services Department offered no objection, however, noted that the on-site sewage disposal will be determined when the Site Plan is oocooIated indicating building size and seating capacity. The Regional Planning Department noted that the lands are designated as nQeuecaI Agricultural &raao" in the Durham Regional official Plan. The predominant use of the lands so designated is agricultural. However, Section 6.3.6 allows the local Council may recognize in the restricted area zoning By-law, police stations, fire stations, public parks, and cultural facilities such as cultural centres libraries, museums and places of worship in any area having first been satisfied that the proposed facility is compatible with its . surroundings. This Section further notes that such a facility should not restrict or conflict with the predominant permitted land ooea: in this case, being agricultural uses. The Ministry of Agriculture and Food reviewed the proposal, giving consideration to the goals and objectives of the FoodIaud Guidelines. Ministry Staff would note the site is level Class l farmland in the General Agricultural designation. This Section, within the FoodIaod Guidelines, states that institutional ooea abmold be directed away from good agricultural land and located in nearby urban areas or marginal resource lands. Based on this Section' Ministry Staff do not recommend approval of the proposal. Staff would note, that in a telephone conversation, of April 37, 1988, Ministry Staff ( calculated the separation distance of an agricultural livestock operation located on the northwest side of 8luoz Street and Doortioe Toxud' immediately adjacent to the subject property, as being 435 feet from the barn. The arc would encroach on the subject lands, however, Staff would note that the development would take place on the southerly portion of the subject parcel, therefore the arc does not encroach on the development itself. Iu addition to this oouoecu, Staff would note that the applicant has recently submitted the site plan drawings (see attached) illustrating the extend and location of the development. Staff would note that the church location has been proposed, taking into consideration the Dbvaioal terrain (ie. : treed REPORT N0. : PD-107-88 PAGE 4 _______________________________________________________________________________ sloping lands to the north, and existing treed line to the west) of the property. In consideration of the site plans, Staff has recently forwarded same to the various departments and agencies for their comments. Staff are of the opinion that the comments of the Ministry of Agriculture and Food are required, in light of the site plan as proposed. Furthermore, the comments of the Regional Works Department are essential re: access, ivaomoob as the proposal requires aroeao onto Regional Road 0o. 34. In consideration of the above, Staff would respectfully recommend that the application be referred back to Staff in order that the applicant can meet with Ministry of Agricultural and Food to discuss Ministry 000cecuo and provide Staff the opportunity to review the comments from the Regional Works Department.
