SUBJECT: REZONING APPLICATION - ANTONIO AND EMILIA CHECCHIA
PART LOT 35, CONCESSION 3, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-102-88 be received; and
2. THAT the attached by-law amendment amending By-law 84-63, as amended, to
permit the development of one (1) additional urban residential lot within
Part Lot 35, Concession 3, former Township of Darlington, be approved and
forwarded for Council for approval; and
3. THAT the applicant be so advised.
BACKGROUND AND COMMENTS:
Staff would note for the Committee's information that the above-noted application
DEV 87-102 to permit the severance of one (1) additional residential lot was
previously considered by Committee and Council at their regular meetings of
February 15, 1988 and February 22, 1988 respectively. In consideration of same,
By-law 88-22 amending By-law 84-63 was approved by Council at the February 22, 1988
meeting. The subject site was included within the "Urban Residential Type One -
Special Exception (R1-17)" zone, thereby permitting a single detached dwelling on

u lot with a minimum lot area of 2I00 square metres.
During the circulation period of the above-noted by-law" it was brought to
Staff's attention that inadvertently the minimum lot area as contained within
the nRI-17" zone would not permit the creation of an additional residential lot
on the subject lands in consideration of the total holdings of the applicant.
Accordingly and in consideration of same, Staff would respectfully request that
the attached by-law amendment be considered for approval to implement the
recommendation of approval as contained within Staff Report PD-45-88 (copy
'
attached) .
Staff would note for the Committee's information that the lot area as contained
on the By-law amendment attached hereto is noueloteut with the application as
previously submitted, furthermore, would note that no objections to the proposal
or the approval of By-law 88-23 was received by Staff.
Accordingly and in consideration of the above-noted comments, Staff would have
no objections to the approval of the by-law attached hereto.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Section 12.4 "Urban Residential Type One Exception (R1)" zone of
By-law 84-63, as amended, is hereby further amended by adding thereto the
following new Subsection 12.4.19 as follows:
"12.4.19 URBAN RESIDENTIAL TYPE ONE EXCEPTION (R1-19) ZONE
Notwithstanding Section 12.2, those lands zoned "(R1-19)" on the
Schedules to this By-law shall be subject to the following zone
regulations:
a) Lot Area (minimum) 1,700 square metres"
2. Schedule 114" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Urban Residential Type One Exception
(R1-17)" to "Urban Residential Type One Exception (R1-19)" as shown on the
attached Schedule "X" hereto,
3. Schedule "X" attached hereto shall form part of this By-law.

4. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 34 of the Planning Act.

It is respectfully recamnended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-45-88 be received; and
2. THAT the application for rezoning submitted by Antonio and Emilia Checchia,
to permit the creation of one (1) additional urban residential lot, be
approved, and;

3. THAT the attached By-law be forwarded to Council for approval.
BACKGROUND AND COMMENTS:
On December 2, 1987, the Planning Department received an application submitted by

Antonio and Emilia Checchia to rezone a parcel of land within Part of Lot 35,
Concession 2, former Township of Darlington to permit the development of one (1)
additional residential lot.
The subject lands are designated as "Residential" in both the Durham Regional
Official Plan and the Newcastle Official Plan. The proposed residential use is
permitted within each document.

In accordance with approved policy, the subject application was circulated to
various agencies and departments for comments. The following is a summary of
comments which have been received. The following departments/agencies had no
objections:
- Town of Newcastle Fire Department
- Town of Newcastle Building Department
- Central Lake Ontario Conservation Authority
- Region of Durham Health Unit
The Town of Newcastle Community Services Department commented as follows:
"Please be advised that the Community Services Department has no objection to the
above application. I would recommend that cash-in-lieu of 50 land dedication be
requested."
ne Town of Newcastle Public 'Horks Department commented as follows:
"We have reviewed the above-noted application and have no objection provided the
owner submit a lot grading plan satisfactory to the Director of Public Works."
The Durham Regional Planning Department commented as follows:
"...the proposed residential use may be permitted provided that the more detailed
provisions, of the plans have been satisfied and the use is serviced by municipal
water and sanitary sewers.
At the present time municipal water is available. However sanitary sewer services
are not .and the Region has no plans to extend sanitary sewers to the site. Section
8.1.3.1 of the Durham Plan permits development on private services in the urban
area as an exception.
In the event the Town favours this proposal, the Region will require as a condition
of approval, the payment of development charge levies for the new lots; the
dedication of a 17 foot road widening on the total frontage of Townline Road; and
satisfactory arrangements with regard to the provision of future services."
This application, if granted, will permit the severance and development of one (1)
additional urban residential lot. Each of these lots will conform to the
applicable provisions of the "Urban Residential Type One (Rl)" zone except for
services. The By-law requires that full municipal services be provided or a
Servicing Agreement being entered into.
Staff would note that there will be a number of conditions attached to the creation
of the additional lot when an application is submitted through the Land Division

Committee. These conditions will include lot development fees, cash-in-lieu of
parkland dedication, lot grading plans, road widenings. In addition the applicant
would be required to enter into a servicing agreement with the Regional Public
Works Department. All of these will be attached as conditions to the Land Division
application. Staff would confirm that the approval of the attached by-law would
permit the development of only one additional residential lot, inasmuch as the
minimum lot area requirement is 2,100 square metres (22,614 square feet) .
Accordingly, and in consideration of the above-noted comments, Staff have no
objection to this rezoning as this is an area designated for residential growth,
therefore. Staff is recommending approval of the attached by-law.

Exception (R1-17)" as shown on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date ce passing hereof, subject
to the provisions of Section 34 of the Planning Act.
