RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-99-88 be received; and
2. THAT rezoning application DEV 88-20 submitted by Dufferin Concrete be
referred back to Staff for further processing and the preparation of a
subsequent report upon receipt of all outstanding comments; and
3. THAT a copy of Council's decision be forwarded to the applicant and the
interested parties indicated hereto.
BACKGROUND AND COMMENTS:
On February 16, 1988, the Town of Newcastle Planning and Development Department
received an application from Dufferin Concrete Products to rezone a parcel of land
to permit the expansion and continued use of a ready-mix concrete operation.
Staff would note for the Committee's information that, pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the subject
lands, and surrounding property owners were advised of the proposal.

The subject property is presently zoned "General Industrial (M2)" in the Town's
Comprehensive Zoning By-law 84-63, as amended. The land is presently used for
a ready-mix concrete operation, as a legal non-conforming use. The applicant
proposed to expand and modernize the operation, therefore requiring Site Plan
approval. However, in order to enter into a Site Plan Agreement, the property
must be zoned appropriately under By-law 84-63.
COMMENTS:
To date, comments have not been received from the Central Lake Ontario
Conservation Authority (CLOCA) and Ministry of the Environment.
Staff note that conversations with Central Lake Ontario Conservation Authority
Staff indicate the western third of the property is within the Regional Storm
Floodline. The applicant proposes to construct a garage within this area, and
therefore, requires C.L.O.C.A. approval for this. Dufferin Concrete has made
application to the Conservation Authority for approval of this garage. The
hearing was held April 19, 1988. At the time of writing this report, Staff had
no further information from C.L.O.C.A. , however, comments will be received from
Authority Staff as to the result of the hearing and other necessary remarks at
their earliest convenience.
The Town's Public Works Department Staff has met with representatives from
Dufferin Concrete on several occasions to discuss concerns and requirements for
Site Plan and Rezoning approval.

The following items have been discussed as needing to be addressed through
revisions to the Site Plan:
(i) resurfacing West Beach Road to an industrial standard
(ii) intersection design at Port Darlington Road & West Beach Road
(iii) regarding, topsoil and sodding of existing ditches
(iv) entrance construction; and
(v) entrance illumination.

Regional Planning Staff have noted the subject property is designated "Major
Open Space" and "Environmentally Sensitive" with indications of "Hazard Lands"
in the [mcbam Regional official Plan. The proposal would appear not to conform
to Official Plan policies. However, Section 16.6.5 of the aforementioned Plan
does provide Local Council with the flexibility to zone for the continued use
and expansion of existing, non-conforming uses, subject to several provisions.
Regional Health Unit noted they are not in a position to comment on the
applications until the plans illustrate both proposed and existing sewage
disposal systems.

Regional Works Department has noted that the existing ready-mix concrete plant
is presently serviced with municipal water supply (250mm watecmmiu) . However,
the applicant is requesting a new 150mm water service for the proposed plant
expansion and has paid connection charges.
Regional Works have further noted the application has indicated the plant will
continue to utilize private sewage disposal. However, sanitary sewer service,
if requested, is available on site tbcnogb the abutting 1200mm sanitary trunk
sewer on an easement.
Canadian National Railway Staff, although not objecting to the proposal, noted

the boundaries illustrated on the Site Plan are not acceptable and requested a
more accurate survey of the applicant's property. At the time of drafting this
report, the applicant was in the midst of preparing a new site plan.
Ontario Hydro, Newcastle Fire Department and the Newcastle Building Department
all indicated no objection to said proposals.
As noted earlier, the applicant is revising the Site Plan to incorporate the |
above-noted problems and deficiencies. When the new drawings have been
reviewed and oounneuta received from the necessary circulated agencies, Staff
will be in a position to make a recommendation to Committee and Council on the
proposed rezoning.

Based on the information presented above, observations from commenting
agencies, comments and reports still outstanding, Staff are not presently in a
position to make a recommendation on the subject applications. Staff recommend
that, at such time as all outstanding comments and revised plans are received,
and the above-noted noucecuo addressed, Staff will be in a position to write a
report making a recommendation on said application.
