RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-95-88 be received; and
2. THAT the request submitted by Mr. Grant Armstrong, on behalf of Aloise
Construction Ltd. thereby exempting Block 74 as shown on Plan 1OM-781
from Part Lot Control, be acknowledged; and
3. THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49, Subsection (7) of the
Planning Act; and
4. THAT Mr. Grant Armstrong of McGibbon, Bastedo, Armstrong & Armstrong be so
advised.
BACKGROUND AND COMMENT:
On April 11, 1988, Staff received a request from Mr. Grant Armstrong, of McGibbon,
Bastedo, Armstrong and Armstrong, Barristers & Solicitors for an exemption from Part
Lot Control in respect of Block 74 as shown on registered Plan 1OM-781. Staff have

reviewed the request and would have no objection to same and the approval of
the by-law exempting the subject lands within this plan from Pact Lot Control.
Staff would note that the development of Block 74' as stipulated in the
Subdivision Agreement, required the use of adjacent lands to create the
appropriate lot. In consideration of same and as noted in Mc. /\cmatcoug'o
letter dated April 7, 1988, the subject land, being under both the Registry
system and Land Titles system, require not only the passing of m Part Lot
Control Exemption By-Iawv but the submission by the applicant of a severance
application for those pacts under the Registry System. Staff would note the
appropriate conditions affecting same would be addressed in the Land Division
process.

Accordingly and in consideration of the above oVomeuta' attached herewith is a
by-law which requires the approval of Council and the Regional Municipality of
Durham which would exempt the subject lands from Section 49(5) of the Planning
Act Doceuout to the Dzovioiuua of Section 49(7) of said Act.
Accordingly and in order to facilitate conveyance of title of the individual
semi-detached units located on these lots, it would be appropriate for the
Council to approve the necessary exemption from Part Lot Control.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88-
being a By-law to designate a certain portion of a registered plan as not being
subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Block 74 of Plan 1OM-781, registered
at the Land Registry Office for the Land Registry Division of Newcastle (No. 10)
on August 1, 1986.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. THAT Subsection (5) of Section 49 of the Planning Act shall not apply to
those lands described in Schedule "A" attached to this By-law.
2. This By-law shall come into effect upon being approved by the Regional
Municipality of Durham and thereafter Subsection (5) of Section 49 shall cease
to apply to the lands described in Schedule "A" attached hereto.
3. Schedule "A" attached hereto shall form part of this By-law.
