MEETING OF JANUARY 21 , 1985

SUBJECT: OFFICIAL PLAN AMENDMENT APPLICATION
FARM-RELATED SEVERANCES FILE: 83-38/D; AND
OFFICIAL PLAN AMENDMENT APPLICATION
FARM-RELATED SERVICE INDUSTRIES FILE: 83-40/D
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-11-85 be received; and
2. That the Regional Municipality of Durham be
advised that the Town of Newcastle wishes to
withdraw Official Plan Amendment applications
Files: 83-38/D and 83-40/D in respect of farm-
related severances and farm-related service
industries, respectively, on the understanding
that Regional Planning Staff will continue to
study the general issues raised through these

proposed amendments and keep the Town informed
of the progress of this analysis as part of
their review of the Durham Regional Official
Plan.

BACKGROUND AND COMMENTS
On December 18, 1984, Staff received the attached
correspondence from Dr. M. Michael , Commissioner of
Planning, Regional Municipality of Durham. This correspond-
ence follows from a meeting that was held on December 11 ,
1984 to review outstanding development concerns in an effort
to arrive at their resolution. The subject applications for
Official Plan Amendment were initiated by the Town of
Newcastle in response to specific concerns of Town Staff
relative to the use of One Foot Reserves by the Durham
Regional Land Division Committee and the establishment of
Farm-related Service Industries. These concerns were
related to specific development proposals and have been,
subsequently, resolved through approval of By-law 84-63, the
Town of Newcastle's Comprehensive Zoning By-law.
In the case of the use of One Foot Reserves, the Town's
By-law provides for such situations through the Agricultural
zone provisions relative to lot frontage.
With respect to the Farm-related Service Industries, this
proposed amendment arose from a specific situation which was
recognized as an existing use through Comprehensive By-law
84-63 and which is now deemed to be in conformity with the
Durham Regional Official Plan.
Regional Staff are suggesting that the Town withdraw these
amendment applications on the understanding that the general
issues will be reviewed as part of the Region's required
review of the Durham Regional Official Plan. Staff do not
have any objection to this proposal and as such would
recommend that the Region be so advised.

Further to our meeting of December 11, 1984 in which the above-
noted matters were discussed, we would like to suggest the
following approach in dealing with these outstanding proposed
amendments of your Council . It is our understanding that this
approach was mutually agreeable.
It would appear that the particular issues which brought your
Council to recommend the above two general amendments have now
been resolved through the approval of the comprehensive zoning
by-law for the Town. As a result, the immediacy of dealing with
these issues no longer exists although it is understood and was
agreed that the general issues raised in these proposed amendments
would require further study.
As a result, it is suggested that the Town withdraw the above-
noted amendment applications which would allow us to close the
files on these issues. We would appreciate receiving a resolution
from your Council to this effect. Subsequently, we would keep you
informed of the progress of our analysis related to the more
general issues raised in the original proposed amendment.
