That Report PD-17-85 be received; and 2. That Report PD-163-84 be lifted from the table; and 3. That Report PD-163-84 be received; and 4. That the Region of Durham be advised that the Town of Newcastle recommends that application for Official Plan Amendment, File OPA 84-19/D, submitted by M. Pedwell to permit the develop- ment of sixteen (16) residential lots in Part of Lot 31 , Concession 2, geographic Township of Clarke be denied without prejudice; and 5. That a copy of Council 's decision be forwarded to the Regional Municipality of Durham and each of the individuals that made submissions to the Town and the Region with respect to this application. )A, REPORT NO. : PD-17-85 Page 2 BACKGROUND AND COMMENT: On October 1 , 1984, the General Purpose and Administration * Committee considered Staff Report PD-163-84 (copy attached) in respect of the subject application to amend the Durham Regional Official Plan. As a result of the Committee's consideration, the following resolution was passed: "THAT Report PD-163-84 be tabled; AND THAT the Town of Newcastle request the Region to review the Official Plan section on Clusters in rural and open space areas; AND FURTHER THAT the Region review the rounding out and/or infilling in residential groupings that are not now defined as Clusters". On November 13, 1984, the Regional Planning Committee * considered Commissioner's Report No. 84-201 (copy attached) and was subsequently received, for information, at the Council meeting of November 21 , 1984. Sections 2.1 .5 and 2.1 .6 of the Commissioner's Report concludes that the present approach to dealing with non-farm residential development is flexible enough to accommodate various infilling situations while protecting the high priority agricultural areas of the Region and preventing large strip developments. No change was recommended to the Regional Policies. In view of the Region's position, it is therefore appropriate to lift Staff Report PD-163-84 from the table, and approve the Staff recommendations contained therein. That a copy of Council 's decision be forwarded to the Region of Durham and each of the residents who have made submissions to the Town and the Region with respect to this application. i . ..2 i i REPORT NO. : PD-163-84 Page 2 BACKGROUND: On July 10, 1984, the Town of Newcastle was advised by the Region of Durham that it had received an application submitted by Mr. Maurice Pedwell to amend the Durham Regional Official Plan to permit the establishment of sixteen (16) Estate Residential lots in Part of Lot 31 , Concession 2, former Township of Clarke. The proposed lots would be located on the west side of Bellwood Drive (the road allowance between Lots 30 and 31 ) and are proposed to have, on average, an area of 1 ,859 square metres (20,000 square feet) and a frontage of 30.48 metres (100 feet). The proposal as submitted would result in the western portion of the entire existing lot, which has an area of 6.98 hectares (17.26 acres) , being land-locked. The applicant has indicated that, if the proposal is approved, these remaining lands would probably be sold to the owners of adjoining orchards. In support of his proposal , the applicant has indicated that hydro electric, telephone and natural gas services are already in place to serve the existing thirty-two (32) lots located on the east side of Bellwood Drive, and that the proposed development would not require the extension of these services. The applicant has also noted that Bellwood Drive is currently maintained by the Town and has suggested that further improvements to the road are not required. The applicant has also submitted a Soils Report which states that the subject lands are suitable for the construction of septic tile beds and house foundations, and that there is sufficient groundwater available for domestic use. . ..3 REPORT NO. : PD-163-84 Page 3 SUMMARY OF CIRCULATION COMMENTS: In accordance with departmental procedure, the application was circulated to various departments and agencies for comment; as well , the Region of Durham Planning Department provided copies of comments received through its circulation of the application. The following is a summary of the major comments received : Town of Newcastle Public Works Department No objection. The comments related primarily to matters addressed in a Subdivision Agreement ; however, the department noted that the Owner must contribute to the future reconstruction of Bellwood Drive to the Town's minimum paved road standards. Town of Newcastle Fire Department Suggested that consideration be given to fire protection requirement for rural development. Region of Durham Health Unit Required drilled wells which are to be located at the eastern perimeter of each lot between the house and the road, and advised of probable land restructure requirements i in order to achieve gravity flow sewage systems. Ministry of Agriculture and Food i Consideration has been given to this proposal in terms of the goals and objectives of the Ministry and of the criteria and policies outlined in the Foodland Guidelines. Soils on the site are Class 1 for agricultural production. The site is presently in hay production. Surrounding uses to the east are a strip of homes along Bellwood Drive , to the south and west the lands are growing corn and to the north is an abutting, orchard. The Foodland Guidelines states that Estate Residential development should occur only on soils of low agricultural i capability well removed from agricultural activity. As this proposed development is on good agricultural soils and not removed from agricultural activity, the Ministry must object to the proposal . i . . .4 REPORT NO. : PD-163-84 Page 4 A total of thirty-nine (39) residents submitted objections to the proposed Official Plan Amendment. These objections were received in the form of eleven (11 ) letters and one petition. The following is a summary of the major concerns sited by the residents: - the area is designated agricultural and not residential - the presence of agricultural uses in the immediate area - the impact on existing wells - the loss of country atmosphere for residents along Bellwood Drive and decreased property values - increased traffic on Bellwood Drive - increased taxes and demand for services - the precedent established by allowing agricultural land to be developed residential . As well , the former owner of the land submitted a letter stating that the subject property is not prime agricultural land and that the land was best suited for housing. A letter submitted by another resident indicated that, in his opinion, there would be adequate water to service the proposed lots without affecting present wells on the opposite side of the road. COMMENT: The property subject to the Official Plan Amendment application is designated "Permanent Agricultural Reserve" by the Durham Regional Official Plan. The Official Plan states that the use of land within this designation for any purpose other than agriculture and farm related uses shall not be permitted. The applicant has stated in support of his application that the residential use of Bellwood Drive . ..5 REPORT NO. : PD-163-84 Page 5 has already been established by the presence of thirty-two (32) existing homes located on the east side of the road. Staff note however, that under the provisions of the Regional Official Plan, the presence of non-farm residential dwellings on one side of a road cannot be used as a basis for permitting development on the opposite side: as well , the Plan clearly discourages the creation of strip or ribbon development . The subject property was zoned "A-Agricultural " by By-law 15g2,as amended, of the former Township of Clarke. The minimum lot area and frontage for new residential lots in this zone was 16.2 hectares and 100.5 metres. The subject property is currently zoned "A-1 Agricultural " by By-law 84-63, the Comprehensive Zoning By-law. This zoning in the Comprehensive Zoning By-law reflects land designated Permanent Agricultural Reserve by the Durham Regional Official Plan. The applicant has indicated that the proposal has been submitted with the intention of the subject lands eventually being rezoned to "RC-Rural Cluster". Staff note however that the areas proposed for the new lots would be considerably below the 3,000 square metre minimum area requirement established by the Rural Cluster Zone. As well , the Regional Official Plan specifically states that Rural Clusters shall be permitted only within the General Agricultural area and the Major Open Space area as designated by the Official Plan. I Based on the above arguments , Staff are of the opinion that the subject application is not in conformity with the Regional Official Plan , and if approved, would seriously undermine one of the basic tenets of the Durham Regional Official Plan - that is, the preservation of the . . .6 REPORT NO. : PD-163-84 Page 6 agricultural areas of the Region and in particular , land designated as prime agricultural land. Staff also reference the objection of the Ministry of Agriculture and Food to the proposed development. With respect to the objections to the proposed amendment submitted by area residents, it is not appropriate for Planning Staff to comment on many of the concerns inasmuch as they lie outside the sphere of normal planning considerations . However, many of the concerns sited , for example, the precedent established by allowing agricultural land to be developed residentially, and the presence of agricultural uses in the immediate area, are in keeping with the concerns of Planning Staff with this application. It is therefore recommended that the Region of Durham be advised that the Town of Newcastle recommends that Official Plan Amendment application submitted by Maurice Pedwell be denied. OAKES, TOWN CLERK, TOWN OF NEWCASTLE RECOMMENDATIONS 1. THAT Correspondence dated October 11 , 1984 from D.W. Oakes , Town Clerk , Town of Newcastle with respect to nodes and clusters be received for information; and 2. THAT a copy of Commissioner's Report No. 84-201 be forwarded to the Council of the Town of Newcastle. REPORT 1. Background 1.1 By letter dated October 11 , 1984 (Appendix I ) , the Council of the Town of Newcastle has requested the Region to review the Durham Regional Official Plan with respect to the issue of nodes and cluster's of non-farm residential dwellings within the rural areas of the Region. 1 .2 It would appear that this request has resulted from the Town 's review of an Official Plan Amendment application, the purpose of which is to permit 16 small ( .4 ac) lots in a strip fashion along an existing road in the Permanent Agricultural Reserve Area. This application has been tabled by the Town of Newcastle at this time. 1 .3 In this regard, certain rural lot inventory information has also been prepared and is presented in Section 2 .2 of this report . 2. Report 2.1 Nodes and Clusters 2.1 .1 Residential development within the Region consists of two main types . The majority of residential growth has taken place and has been provided for within the Major and Small Urban6Areas identified in' the Durham Official -683 Commissioner' s Report No. 84-201 Page 2 Plan. These areas consist of communities which have experienced growth, contain a variety of support facilities , and generally are serviced with municipal water and sewer facilities. Extensive lands have been identified for development within these urban areas. A second type of residential development consists of that which has taken place within the rural areas of the Region. Development within this category consists of: i ) hamlets, ii ) small nodes and clusters of homes , iii ) estate residential development, and iv) shoreline residential development. In addition, it should be noted that the plan contains provisions which would allow for the development of non-farm residential uses on vacant lots of record scattered throu'ghout the Region. Approximately 3000 vacant lots under 25 acres in size presently exist within the rural areas . Lots may also be created by consent related to farm operations. 2.1.2 In order to strike a balance between pressures to allow rural non-farm development and the objectives identified in the Official Plan related to directing growth to settlement areas and reserving the rural areas predominantly for agricultural and open space uses, twelve clusters were identified in the Official Plan (Section 10.2.1.3) . Furthermore, due to the significant amount of work required in order to research and identify all the clusters in the Region , a policy has been included in the Plan allowing the area municipal Council to identify non-farm residential clusters in the rural areas , outside of the Permanent Agricultural Reserve Areas, if such clusters are recognized in the zoning by-law. The identified clusters could be used as an example for that purpose. In these instances, infilling could be permitted within small concentrations of existing structures by the creation of two or three lots yet preventing the proliferation of extensive strip development across the Region. 2.1 .3 Nodes and clusters could be considered to be , in effect , the nucleus of i hamlets which had not expanded over time. Nodes and clusters have been recognized in order to allow further limited development in rural areas . Scattered and strip development, however, were not encouraged to proliferate across the Region because of the various implications associated with such development. Schedule 'A' contains illustrations of the concept of the form of nodes , clusters, scattered and strip developments. 2. 1.4 Residential development is also permitted under the agricultural related severance provisions of the Official Plan. In this connection, a portion of the severances permitted for agricultural purposes can be considered as serving the non-farm residential pressures. For example, a lot created for a farmer's retirement may be sold to urbanites strictly as a non-farm property. A portion of lots created through farm consolidation actions also add to the supply and diversity of non-farm residential opportunities. 63 684 Commissioner's Report No. 84-201 Page 3 2.1 .5 In conclusion, the approach described provides for a reasonable and balanced approach in dealing with non-farm residential development in the rural areas. Accordingly, the implementation of the existing policy provides for rural development as follows in: • some small urban areas (on private services ) • hamlets • estate residential subdivisions • clusters and nodes • shoreline residential areas • existing lots of record • "farm" related severance. 2.1 .6 Experience to date indicates that the policies developed over time in the Official Plan with respect to nodes and clusters is flexible enough to accommodate various infilling situations while protecting the high priority agricultural areas of the Region and not proliferating large strip developments . Area municipal Councils , within this framework, may identify nodes and clusters within their respective zoning by-law in order to permit infilling. No change is recommended to the existing policies dealing with nodes and clusters and, as a result, the Town of Newcastle be so advised. 2.2 Rural Land Inventory 2.2.1 In conjunction with the preceeding discussion of nodes and clusters , the attached information has been prepared in order to provide a summary of the non-farm residential development activity in the rural areas of the Region. 2.2.2 Table 1 contains a summary of assessment information detailing the distribution of permanent residential shelter units on the basis of urban/rural areas as defined in the Durham Regional Official Plan. 2.2.3 Table 2 contains a listing of the active residential developments within the rural areas of the Region. Active developments are defined as proposals which may contain any of the following criteria as identified in the Status column of the table . i ) OPA - Development applications subject to Official Plan Amendment application which has not yet been approved by the Ministry Of Municipal Affairs and Housing but may have been approved by Regional Council . ii ) PRE - Preliminary Plans of Subdivision or applications which have received official plan approval but no subdivision application has yet been received. 64 Cunnnl';; loner' :; R��purt Nit'. 54-201 I''i'l(' 4 08 tJ iii ) DRA - Draft Approved Plan of Subdivision ; and iv) REG - Registered Plan of Subdivision in which vacant lots still exist. This information is grouped by area municipality and by the development type as follows: i ) EST - Estate Residential development ii ) HAM - Development in the hamlets as identified in the Durham Regional Official Plan iii ) 0TH - Other developments within the Region which may include shoreline residential proposals , exceptions as identified in the Plan or other rural developments. Information on the number of vacant lots within registered plans of subdivision represents year-end 1983 information. A further division of vacant lot information is provided by identifying within registered plans lots owned by individuals - "Ind Vac"; and lots in which the developer still retains ownership - "Dev Vac". Maps I to 6 which accompany Table 2 provide a general indication of the location and size of the active rural residential developments listed in Table 2 . 2.2.4 Table 3 contains a listing of only the estate residential proposals approved tinder the provisions of the Durham Regional Official Plan. This information represents an extract from the information provided in Table 2 and serves to highlight the estate residential component of rural non-farm residential development . Dr. M.
