That Report PD-10-85 be received for information; and 2. That Report PD-21 -85 be received; and 3. That the criteria within Staff Report PD-21-85 and * noted in Attachment No. 1, be adopted by Council in place of the existing residential Nodes and Clusters Criteria adopted by Council on November 13, 1984; and 4. That By-law 84-156 as revised and included as * Attachment No. 2 to Staff Report PD-21-85 be approved; and 5. That a copy of the said Criteria be forwarded to the Region of Durham Planning Department for their information and records. II I . . .2 I 1,,1 I a -° i REPORT NO. : PD-21-85 Page 2 BACKGROUND AND COMMENTS: At the General Purpose and Administration Committee meeting of January 21 , 1985, the Committee considered Staff Report PD-10-85 in respect of Rural Residential Nodes and Clusters. The Committee resolved to refer the matter back to Staff for inclusion of various comments provided by Committee members with the revised Criteria to be submitted to the next Council meeting. Included as Attachment No. 1 is the revised Criteria and included as Attachment No. 2 is revised By-law 84-156 in respect of an appeal submitted by the Region of Durham relative to the zoning of a rural cluster located in Part of Lot 22, Concession 3, geographic Township of Darlington. Staff note that the suggested Criteria have been accepted by Regional Staff as being in conformity with the Durham Regional Official Plan and that By-law 84-156 would resolve an outstanding appeal in respect of the Town's Comprehensive Zoning By-law. The property owner affected by By-law 84-156 is entitled to appeal to the Ontario Municipal Board if they so desire. Mills Group 7, Box 7 R.R. #3 BOWMANVILLE, Ontario L1C 3K4 i ATTACHMENT NO. 1 TO REPORT TOWN OF NEWCASTLE CRITERIA FOR IDENTIFYING RURAL NODES AND CLUSTERS For the purposes of this policy rural Nodes or Clusters are defined as areas of rural non-farm related residential development which exhibit similar lot characteristics and contain a minimum of three (3) and a maximum of six (6) existing residential lots for which building permits would be available and within which infilling may occur up to a maximum of three (3) additional lots. A rural Cluster shall be defined as areas bounded on, at least, three (3) sides by natural or physical boundaries such as watercourses or public streets. A Node shall be defined as an area having a main focal point such as a school , community centre, church or general store. In addition to the foregoing, rural Nodes or Clusters shall not be permitted in areas designated as "Permanent Agriculture Reserve" by the Regional Official Plan. In other designations Nodes or Clusters shall not be permitted in areas located adjacent to active, agricultural operations. Where a Node or Custer is designated, it must comply with the Agricultural Code of Practice and the applicable provisions of the Town's Zoning By-law. I i i II THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84-156 being a By-law to amend By-law 84-63, Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63 of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as follows: 1. Schedule 1 is hereby amended as follows: a, by deleting the "RC" zone classification of Part of Lot 22, Concession 3, geographic Township of Darlington as shown on the attached Schedule "X-1" and replacing same with the zone designation "A". 2. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act, 1983. That a copy of said Criteria be forwarded to the Region of Durham Planning Department for their information and records. . . .2 REPORT NO. : PD-10-85 Page 2 BACKGROUND AND COMMENTS: On November 13, 1984, Council adopted a number of criteria to be used in evaluating applications for designation as a residential node or cluster. These criteria were forwarded to the Regional Municipality of Durham and, on December 11 , 1984, Staff met with Regional Planning Staff to review the criteria and discuss a number of concerns raised relative to Official Plan conformity. As a result of those discussions, Staff have revised the criteria in order to accommodate the Regional concerns which were primarily related to establish- ing these criteria as applying to infilling situations and requiring compliance with the Agriculture Code of Practice. * The revised criteria are included as Attachment No. 1 and a copy of the letter from the Regional Commissioner of * Planning included as Attachment No. 2. Dr. Michael 's letter also addresses the issue of the residential cluster zoning in Part of Lot 22, Concession 3 and Part of Lot 26, Concession 2 of the former Township of Darlington. In that regard, the Region is now satisfied that the proposed residential cluster zoning for part of Lot 26, Concession 2 would be in conformity with the Regional Official Plan, and as such, are no longer objecting to that zoning. With respect to the proposed residential cluster zoning in Part of Lot 22, Concession 3, the Regional position remains that this particular .parcel of land does not comply with the Regional Official Plan, and as such, should be rezoned to an "A-Agricultural " zone. * Included as Attachment No. 3 is a copy of a revised By-law 84-156 which was originally considered by the Town 's General Purpose and Administration Committee on December 10, 1984 and which was tabled pending the Staff meeting referred to . . .3 REPORT NO. : PD-10-85 Page 3 herein. Inasmuch as the Public Meeting has already been held, it is in order for Council to approve By-law 84-156 which would, effectively, eliminate one of the Regional appeals in respect of By-law 84-63. espectful d, T.T. MICHAEL, M.C.I.P. Commissioner of Planning Re: a) Criteria for identifying Rural Nodes & Clusters b) By-law No. 84-156, Town of Newcastle File: 84-19/D and By-law 84-156 Further to your letter of December 11, 1984, please be advised that we have no difficulty with the revised criteria for identifying rural nodes and clusters as attached to your letter. This new criteria removes the possibility of conflicts with the provisions of the Durham Regional Official Plan which existed with the old policy. We would suggest that the new criteria replace the existing policy which we understand has been adopted by your Council . With respect to By-law No. 84-156 also attached to your letter, we have reviewed this matter and its approval would remove our earlier concerns with the proposed ' RC' zoning in part of Lot 22, Concession 3, former Township of Darlington. Furthermore, as agreed at the meeting, the proposed ' RC' zoning in part of Lot 26, Concession 2, former Township of Darlington is considered to be in conformity with the Durham Regional Official Plan. I trust you will find this satisfactory and would appreciate being advised when the revised criteria for identifying nodes and clusters has been adopted by your Council .
