REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING
OF FEBRUARY 18, 1985

SUBJECT: MAINSTREET REVITALIZATION PROGRAM
AMENDING AGREEMENTS
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-26-85 be received; and
* 2. That the attached by-laws authorizing execution of an
Agreement between the Town, the Province of Ontario
and the Business Improvement Areas be approved; and .
3. That a copy of this report be forwarded to the
Bowmanville and Newcastle Village Business
Improvement Area Boards of Management for their
information; and
* 4. That the attached Amending Agreement be forwarded to
the Bowmanville Business Improvement Area Board of
Management for execution, and that upon execution,
the Clerk forward the Agreement to the Ministry of
Municipal Affairs and Housing.

BACKGROUND AND COMMENTS:
As the Members of Council are aware, "the Town is party to two
separate agreements with the Province of Ontario and the
Bowmanville and Newcastle Village Business Improvement Areas in
respect of, the repayment of loans provided under the Mai nstreet
Revitalization Program. Under the terms of the present
agreements, repayment of the loans commenced thirty (30) days
after the first business tax date following completion date of the
projects. In the case of our Agreements, this would be July 29th
of each year. The Province recently established a comprehensive
municipal repayment control system which implements a single
repayment date for all municipalities, and in order to facilitate
operation of this system, has requested the Town to execute
amendments to its Main Street Revitalization Program Agreements
which would have the effect of changing the repayment date from
July 29th to September 30th of each year.
Staff have discussed this matter with the Treasurer and are
advised that this change to the Agreement would have no adverse
impacts upon the Town. In that regard, Staff are recommending
* that the subject Agreements be amended and the attached by-laws,
authorizing execution of the Agreements, approved.
Staff note, at the time of writing, we are in receipt of an
amendment to the Bowmanville Agreement only, but are anticipating
receipt of an amendment to the Newcastle Village Agreement in the
near future.

BY-LAW NUMBER 85-
being a By-law to authorize the entering into of an amending
Agreement with the Corporation of the Town of Newcastle and the
Province of Ontario in respect of loan repayment schedule for
Bowmanville and Newcastle Village Mainstreet Revitalization
Programs.
The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
1 . THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal , an amending Agreement between the Province of
Ontario and the said Corporation dated the day of
1985, in the form attached hereto as Schedule "X".

2. THAT Schedule "X" attached hereto forms part of this
by-law.

I
WHEREAS by an Agreement dated the 9th day of February 1.198 3
(herein called the 'Original Agreement") the Minister, subject to
the terms set out in the Original Agreement, agreed to loan to the
Municipality the capital sum of 150,000 for the improvement and
beautificatinn of municipally owned real property within the boundaries
of ttte BCAMTWnVille Central Business Improvement Area, which is under the
management of the Board;
WHEREAS the Municipality has repaid $ 1Fi,r,00 of the $ 165,000
capital and sur:harge amount of the loan as of the date of this amending
agreement;
WHEREAS THE Municipality and the Ministry wish future Inan repayments
to be made nn th,� '30th day of September in each year;
NOW 'THEREFORE 1'1115 AGREEMENT IJITNESSES that in consideration of the
premises and the mutual terms and conditions hereinafter set forth

the parties hereto agree each with the other as follows:
I. Clause 7 of the Original Agreement is deleted and replaced with
the following:
"7. The Municipality shall repay to the Ministry the balance
of the capital and surcharge amount of the loan of
$ 165,000 by annual payments of not less than
$ lt; 500 each commencing on the 30th day of September
1985 and continuing on each anniversary date thereafter
until the loan amount has been paid in full."
2. Save and except for the amendment referred to in clause 1 hereof,
the Parties acknowledge and agree that the Original Agreement
continues in full force and effect.
IN WITNESS WHEREOF the parties hereto have hereunto affixed their
corporate seals, attested by the signatures of their proper signing
officers in that. behalf, all as of the day and year first above
written.
