HANNING'S PLAN TOWN OF BOWMANVILLE FILE: 18T-84035 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-29-85 be received; and 2. That the Regional Municipality of Durham be advised that the Town of Newcastle has no objections to draft approval of Subdivision 18T-84035 as revised in red * and attached hereto, and furthermore subject to the * conditions outlined on Attachment No. 1 to this report; and 3. That a copy of Staff Report PD-29-85 be forwarded to the Regional Municipality of Durham for their information. I i . . .2 i REPORT NO. : PD-29-85 Page 2 BACKGROUND: In October, 1984, an application for subdivision approval was submitted by Mr. Mario Veltri in respect of a 2.2587 ha parcel of land in Lot 12, Concession 2, former Town of Bowmanville. The proposed subdivision would result in the creation of a total of twenty-two (22) single family residential lots. Full municipal services are proposed for the development and would be required pursuant to the provisions of the Official Plan for the Bowmanville Urban Area. The site is designated residential on both the Durham Regional Official Plan and the Official Plan for the Bowmanville Major Urban Area. The lands are presently zoned "A-Agricultural " and "R1-Urban Residential Type One (R1) Zone" by Zoning By-law 84-63. An amendment to permit the development is required; and as such is * included within the conditions of draft approval on Attachment No. 1. In accordance with Departmental procedures the subdivision proposal was circulated to the appropriate authorities/departments for their comments. In reviewing the proposal , the following authorities had indicated no objections to the proposal : Ontario Hydro, Central Lake Ontario Conservation Authority, Ministry of Natural Resources, and the Peterborough-Victoria- Northumberland and Newcastle Roman Catholic Separate School Board. Newcastle Public Works Department "As requested, we have reviewed the above noted application for plan of subdivision and submit the following comments: - That the owner enter into a development agreement with the Town, and that this department be kept informed of the status of same at all times; . . .3 i I i ,6d) REPORT NO. : PD-29-85 Page 3 Newcastle Public Works Department (Cont'd) - That all works are completed in accordance with the Town of Newcastle' s Design Criteria and Standard Drawings; - That any easements required by the Town be granted free and clear of any encumbrances; - All of the other standard requirements re: Lot Grading, Schedules of Work, Performance Guarantees, Cost Estimates, etc. , should be included in the Subdivision Agreement; - That a sight triangle be added to the draft plan as shown in red; - That the applicant constructs High Street from Meadowview Boulevard (including the intersection) to the north limit of this subdivision (+/- 180 metres) ; - That the applicant illuminates High Street to Town Standards and constructs a concrete sidewalk for the frontage width of the subdivision; - That Block 23 be dedicated as public road allowance at the time registration of this plan of subdivision occurs; - That the Owner meet all the requirements of the Public Works Department, financial or otherwise." Ministry of Environment "Staff have completed their review of the subject plan and advise that we do not anticipate any major environmental problems as a result of this development. However, we understand from Staff of the Regional Engineering Department that insufficient water supply pressure exists and that the extension of a diversion sewer will be necessary prior to approval of the development. Further comments in this regard should, therefore, be obtained from the Regional Municipality of Durham's Engineering Department." Region of Durham Works Department "The Regional Municipality of Durham Works Department has reviewed the above noted application for approval of plan of subdivision and wish to provide the following comments with respect to the provision of Regional services. . . .4 REPORT NO. : PD-29-85 Page 4 Region of Durham Works Department (Cont'd) GENERAL The proposed development is outside the "Service Area Limit for Lot Levy Purposes" as established by the 1984 Servicing and Financing Study. WATER SUPPLY The proposed subdivision is within the future Zone II pressure district of the Bowmanville Water Supply System. The Region has no plans to construct the facilities required to provide supply to the Zone II area in the foreseeable future. The existing watermain located on easement within the proposed High Street road allowance is not capable of providing service to the proposed development. Recent pressure and flow tests conducted in this area show that the existing system cannot provide water of adequate pressure and quantity for the proposed development. SANITARY SEWER SERVICE Adequate capacity in the existing sanitary sewer system servicing this area of Bowmanville will not be available until the High Street diversion sewer is constructed through the subdivision proposed by Cean Investments Limited (18T-74067) . Once the diversion sewer is constructed, adequate capacity will be available for the proposed development. Due to the servicing constraints associated with the subject application, the Regional Municipality of Durham Works Department cannot provide favourable comment at this time." i STAFF COMMENTS Staff would note for Committee's information that the applicant has previously made application to the Land Division Committee (LD 167/84) to sever a 534.16m2 lot, for residential purposes, * from the southeast corner of his entire holdings (see attached) . . . .4 REPORT NO. : PD-29-85 Page 5 STAFF COMMENTS In reviewing this application it was noted that Elgin Street had not been closed and conveyed in accordance with the Town of Newcastle Policy. Accordingly and as a condition of approval of the severance, Staff requested that Elgin Street be closed and conveyed in accordance with Town Policy. The applicant, in wishing to comply with the conditions of the Land Division Committee, made application with the Town for closure and conveyance of the road allowance. Staff, in acknowledging this application, advised the Land Division Committee that the condition was satisfied. As the road allowance closure procedure has not be finalized as of the preparation of this report, Staff have included, within the conditions of draft approval , said requirement. With respect to the Works Department comments as noted in this report, Staff would concur with same and have recommended the red-line revisions to reflect the changes necessary. Generally speaking, Staff concur with the concerns of the Region of Durham with respect to servicing and that approval would be premature pending resolution of services. However, Staff would have no objection to the approval of this draft plan, subject to the red-line revisions and conditions outlined in Attachment No. 1 to this report. espe mitted, T. wa rds, M.C.I .P. That this approval shall apply to draft plan of subdivision 18T-84035 prepared by Merrill D. Brown O.L.S. , identified as File No. 84097 - DP, dated September 24, 1984, which is revised in red as per the attached plan showing twenty-two (22) single family lots. 2. That the developer enter into a Subdivision Agreement with the Town of Newcastle. 3. That the Owner grant to the Town, free and clear of all encumbrances, all easements and dedications as requested. 4. That the Owner agrees to pay, to the Town of Newcastle, the cash value of the five percent (5%) parkland dedication in lieu of the parkland. 5. That the works be designed and constructed in accordance with the Town of Newcastle design criteria and standards. 6. That a 6.Om by 6.Om sight triangle on the south-east corner of Lot 22, Court B, be added to the draft plan and dedicated to the Town of Newcastle along with the other noted sight triangles. 7. That the road allowances included in this draft plan be dedicated as public highways. This shall include the dedication of Block 23 as public road allowance. 8. That the streets in this plan be named to the satisfaction of the Town of Newcastle and the Region of Durham. 9. That the Owner agrees, in writing, to satisfy all requirements, financial and otherwise, of the Regional Municipality of Durham, particularly with respect to the provisions of municipal water and sewage supply. 10. That the Owner agrees to construct High Street, as revised, from Meadowview Boulevard, including the intersection, to the north limit of the subdivision, approximately 180 metres. 11. That the necessary amendment to By-law 84-63, Town of Newcastle, as amended, be approved in effect. 12. That Lord Elgin Street be closed and conveyed in accordance with Town Policy to the satisfaction of the Town of Newcastle.
