MEETING OF FEBRUARY 18, 1985

SUBJECT: AMENDMENTS TO BY-LAW 84-63

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-30-85 be received; and
2. That Planning Staff and the Town Solicitor be
authorized to request the Ontario Municipal
Board to amend By-law 84-63 in accordance with
* the attached draft By-law amendments failing
written confirmation from the Regional
Municipality of Durham by March 8, 1985, that
the necessary development agreements have been
executed and registered against title; and
3. That the Regional Municipality of Durham and
the applicants be so advised.

At the General Purpose and Administration Committee meeting
of December 3rd, 1984 the Committee considered Staff Report
PD-188-84 in respect of amendments to Comprehensive Zoning
By-law 84-63. At that time, the Committee adopted the
following resolution:
"THAT the Region and applicants be advised, that
failing execution of appropriate agreements with the
Region in respect of Plan of Subdivision 18T-82037
Zakarow, the Port Darlington Marina Condominium
proposal , and the Pollard apartment proposal , that the
Town will undertake a by-law amendment to add the (H)
Holding symbol to the subject lands."
This resolution was approved by Council on December 10, 1984
and responded to a concern of the Regional Municipality of
Durham relative to the zoning of the lands in question. As
of the date of writing, we are advised that appropriate
agreements have not yet been executed, accordingly, it would
be appropriate for Council to submit, to the Ontario
Muncipal Board, the appropriate by-law amendments to add the
(H) Holding zone provision in respect of these lands.
Similarly, if the individual applicants are able to conclude
their negotiations relative to development agreements prior
to the commencement of the hearing, the necessity for these
amendments would be eliminated. In order to present the
Board with by-laws in a form that has been considered and
* approved by Council , Staff have prepared the attached by-law
amendments which would amend By-law 84-53 to add a (H)
Holding provision in each instance.
Staff feel that it would be appropriate for Council to
authorize Staff to submit the attached by-law amendments to
the Ontario Municipal Board during the course of the Board

Hearing of By-law 84-63 failing agreements being reached
between the individual property owners and the Regional
Municipality of Durham prior to commencement of the Hearing.
In the meantime, Staff will continue to do everything,
within our power, to resolve or assist in the resolution of
these outstanding appeals.

BY-LAW NUMBER 85-
being a By-law to amend By-law 84-63, Comprehensive Zoning By-law
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63 of the Corporation of the Town of
Newcastle.
NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as
follows:
1. Schedule "3" is hereby amended as follows:
a. by adding to the zone designation of the lands shown on
Schedule "X" and "X-1" hereto a Holding zone (H) prefix;
2. Schedule "4" is hereby amended as follows:
a. by adding to the zone designation fo the lands shown on
Schedule "X-2" hereto, a Holding zone (H) prefix.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act,
1983.
