SUBJECT: PROPOSED PLAN OF SUBDIVISION - 18T-81025
EAST WOODBRIDGE DEVELOPMENTS LIMITED
MARTIN ROAD, BOWMANVILLE
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-34-85 be received; and
* 2. That the attached by-law authorizing execution of a
Development Agreement between the Town and Mutt
Enterprises Limited and Tarshead Construction Limited
be approved; and
3. That the Mayor and Clerk be authorized to execute the
aforesaid Development Agreement at such time as it is
finalized to the satisfaction of the Director of
Planning and the Director of Public Works.

BACKGROUND AND COMMENTS:
Proposed Plan of Subdivision 18T-81025 was draft approved by the
Region on August 31 , 1984. One of the conditions of draft
approval of this plan is the execution of a Development Agreement
with the Corporation of the Town of Newcastle. In that regard, a
first draft of the agreement is presently in circulation and Staff
have been advised by East Woodbridge Developments that they are
interested in proceeding with the development of the lands as soon
as possible, and that they are presently negotiating options, with
builders.
In order to expedite clearance of the conditions of draft plan
approval and early execution of a Development Agreement, it is
necessary for Council to authorize the Mayor and Clerk to execute
a Development Agreement between the Town and Mutt Enterprises
Limited and Tarshead Construction Limited.
The subject Development Agreement will follow the Town's standard
format and would be forwarded to the Mayor and Clerk for execution
at such time as the terms and wording have been finalized to the
satisfaction of the Director of Planning and the Director of
Public Works.

being a By-law to authorize the entering into of an Agreement w�th
the Corporation of the Town of Newcastle and Mutt Enterprises Limited

and Tarshead Construction Limited. 6
The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
1 . THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal, a Development Agreement between Mutt Enterprise
Limited and Tarshead Construction Limited and the said Corporation
dated the day of 1985, in the form attached hereto as
Schedule "X".
2. THAT Schedule "X" attached hereto forms part of this
by-law.
