REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING
OF MARCH 4, 1985
REPORT NO. : PD-38-85
SUBJECT: PROPOSED PLAN OF SUBDIVISION - 18T-19720
FOSTER CREEK DEVELOPMENTS LIMITED
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-38-85 be received; and
* 2. That the attached by-law authorizing execution of a
Subdivision Agreement between Foster Creek
Developments Limited and the Town of Newcastle be
approved; and
3. That the Mayor and Clerk be authorized to execute the
Subdivision Agreement between Foster Creek
Developments Limited and the Town of Newcastle at
such time as said Agreement has been finalized to the
satisfaction of the Director of Planning and the
Director of Public Works.

BACKGROUND AND COMMENT:
On May 5, 1981 the Council of the Town of Newcastle authorized
execution of a Development Agreement between East Woodbridge
Developments and the Town of Newcastle. Recently, the subject
plan of subdivision was purchased by Foster Creek Developments
Limited who now want to proceed with the development of the lands.
In order to facilitate this development, it is necessary for the
Town to authorize execution of a new Agreement and for the Town to
review the previously approved agreement and update same in
accordance with current standards and policies.
In that regard, Staff feel that it would be appropriate to
authorize execution of a Development Agreement with Foster Creek
Developments Limited at such time as the agreement has been
finalized to the satisfaction of the Directors of Planning and
Public Works.

BY-LAW NUMBER 85-
being a By-law to authorize the entering into of an Agreement with
Foster Creek Developments and the Corporation of the Town of
Newcastle.
The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
I. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal, an Agreement between Foster Creek Developments
Limited and the said Corporation dated the day of ,
1985, in the form attached hereto as Schedule "X".
2. THAT Schedule "X" attached hereto forms part of this
by-law.
