SUBJECT: APPLICATION TO AMEND DURHAM REGIONAL OFFICIAL PLAN TO
PERMIT ADDITIONAL USES WITHIN SPECIAL PURPOSE
COMMERCIAL AREAS FILE: 84-38/D
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-45-85 be received; and
2. That the Region of Durham be advised that the Town of
Newcastle has no objection to Official Plan Amendment
Application 84-38/D to permit financial
establishments, professional offices and other
personal service uses as an exception within Special
Purpose Commercial Areas at the discretion of the Area
Municipal Council .

BACKGROUND AND COMMENT
On February 8, 1985, the Town of Newcastle was advised by the
Region of Durham of an application to amend the Durham Regional
Official Plan to expand the permitted uses within Special Purpose
* Commercial Areas. Specifically, the proposed amendment (attached)
would permit financial establishments, professional offices, and
other personal service uses to be located in association with
Special Purpose Commercial areas at the sole discretion of the area
municipal Council .
The Durham Regional Official Plan states that Special Purpose
Commercial Areas shall serve the specialized needs of residents on
an occasional basis with services and facilities which consume
larger parcels of land and require exposure to traffic such as and
similar in kind to automotive sales and service, drive-in
restaurants, motels, hotels, lumberyards, furniture and major
appliance sales. The Bowmanville Urban Area Plan contains similar
wording. Neither the Newcastle Village Urban Area Plan nor the
Courtice Urban Area Plan contain policies related to Special
Purpose Commercial Areas since no such areas are designated in
either urban area. The policies in the Courtice Plan relate to
Special Purpose Commercial Nodes, and thus are not covered by the
Regional Official Plan's policies.
Staff have no objection to the proposed amendment inasmuch as the
uses to be permitted by the amendment are compatible with the uses
already permitted within Special Purpose Commercial areas. As
well , Staff further note that the proposed amendment states that
the expansion of uses would be at the sole discretion of the Area
Municipal Councils. This provides local municipalities with
greater flexibility in the determination of appropriate landuses in
Special Purpose Commercial Areas within both local Official Plans
and the Comprehensive Zoning By-law. Staff, however, have not had

the opportunity to thoroughly review the possibility of amendments
to the Bowmanville Urban Area Plan and the Comprehensive Zoning
By-law to incorporate the expanded list of uses permitted by the
proposed amendment to the Regional Official Plan.
It is therefore recommended that the Region of Durham be advised
that the Town of Newcastle has no objection to Official Plan
Amendment Application 84-38/D.
