SUBJECT: SUBDIVISION AGREEMENT
UNITED COUNTIES HOLDINGS LIMITED
PT.LOTS 18/19, CONC. 10, FORMER TWP. OF DARLINGTON
FILE: 18T-75362, PLAN M-753
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-56-85 be received; and
* 2. That the attached amendment to United Counties
Holdings Limited, Veltri and Son Limited, and Lesron
Enterprises Limited and Susan Ann Swartz and the
Corporation of the Town of Newcastle be approved; and
* 3. That the attached by-law authorizing the execution of
an amending agreement between United Counties
Holdings Limited, Veltri and Son Limited, and Lesron
Enterprises Limited and the Corporation of the Town

of Newcastle be approved; and
4. That the subject amending agreement be executed upon
submission of the appropriate fire protection charges
pertaining to Phases One (I) and Two (II) as shown on

Plan M-753.

BACKGROUND AND COMMENT:
Staff recently received a request submitted by Mr. Tony Prevedel ,
P.Eng. , of Marshall , Macklin, Monaghan Limited, on behalf of
United Counties Holdings Limited, Veltri and Son Limited, Lesron
Enterprises Limited and Susan Ann Swartz for consideration of an
amendment to -the subdivision agreement with respect to the
provisions pertaining to the installation of a fire reservoir.
Mr. Prevedel , through discussions with the Fire Chief and Planning
Staff, has been advised of Staff's overall concerns as expressed
in Staff Report PD-40-84 (Council meeting of January 23, 1984)
regarding "Fire Protection Requirements for Rural Development".
To this end, Mr. Prevedel submitted an estimated cost for the
installation of the reservoir; noting that the total cost to
install same would be Thirteen Thousand and One Hundred Dollars
($13,100.00) . This would represent a cost of Two Hundred and
Thirty Dollars ($230.00) per lot (fifty-seven within the total
plan of subdivision).
* The amending agreement attached hereto would reflect the deletion
of the requirements for the installation of the reservoir and
replace same with the payment of a Fire Development Charge as
noted above.
Pertaining to the format of the amending agreement, Staff would
note that as several lots within Phases I and II (comprising Plan
M-753) have been sold, the legal description attached to the
agreement excludes that area within Plan M-753.
Accordingly, Staff would request that payment of the Fire
Protection Charge for Phases I and II (being $230.00/lot . . . 14
lots) be made prior to the executing of this amending agreement.

The remaining monies (fire protection charges, development charges
etc. ) would be receivable at such intervals as noted within the
agreement.
Staff would note for Committee's information that the above items
have been discussed with Mr. Prevedel on behalf of the applicants
and furthermore, forwarded to their Solicitor for his concurrance
to same.
