OF DARLINGTON - ESTATE RESIDENTIAL DEVELOPMENT - RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-61-85 be received; and 2. That the Region of Durham be so advised that the Town of Newcastle recommends approval of Plan 18T-85002, * dated January 22, 1985, as revised in red and attached hereto and furthermore, subject to the conditions * contained in Attachment No. 1 to this report; and 3. That a copy of Staff Report PD-61 -85 be forwarded to the Region of Durham; and * 4. That the attached by-law authorizing execution of a Subdivision Agreement between 464367 Ontario Limited and the Corporation of the Town of Newcastle be approved; and 5. That the Mayor and Clerk be authorized to execute the Subdivision Agreement between 464367 Ontario Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. J • • •2 C� REPORT NO. : PD-61-85 Page 2 BACKGROUND AND COMMENT: Amendment No. 126 to the Official Plan for the Regional Municipality of Durham Planning Area was approved by the Ministry of Municipal Affairs and Housing on March 8, 1985. A copy of said Notice of Approval , as forwarded by Ministry Staff, was received on March 28, 1985. The purpose of said amendment to the Durham Regional Official Plan was to permit the development of a maximum of seventeen (17) estate residential lots. Subsequent to, and in consideration of the requested Official Plan Amendment as stated above, on February 4, 1985, the Newcastle Planning Department received notice, through the Region of Durham Planning Department, of an application for subdivision approval for a seventeen (17) lot estate development. Staff would note for Committee's information that a rezoning application was submitted on March 29, 1985 to implement said plan of subdivision. At such time that the application has been circulated and pursuant to the notice requirements within the Planning Act, a report will be forwarded to Committee and Council . In accordance with departmental procedures, the subject proposal was circulated to obtain comments from other departments within the Town. The comments received are summarized below, as are the comments which the Region of Durham received during their circulation process. Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board "In reply to your request please be informed that the Board has no objections to the proposed plan." Ministry of Transportation and Communications "This subdivision does not abut a King's Highway and at the present time, is not affected by any plans of this Ministry. We will not require copies of the final or registered plans for this file. However, we would like to be advised of the registration date and number." . . .3 REPORT NO. : PD-61-85 Page 3 Ministry of Natural Resources "Ministry Staff have reviewed this draft plan of subdivision. We have no objections to the approval of this proposal . A licenced pit is located immediately to the east of the site, on Regional Road 57. We anticipate that this pit will be rehabilitated within two years, thereby minimizing any potential impacts of the extraction operation on the area to be subdivided. The pit is now well screened along Regional Road 57." Ministry of Agriculture and Food Foodland Preservation Branch "Staff of the Ontario Ministry of Agriculture and Food have reviewed the above development proposal . Considereation has been given to the proposal in terms of the goals and objectives of the Ministry and of the criteria and policies outlined in the Food Land Guidelines. In a letter dated October 14, 1983, the Ministry provided comments to the Durham Region Planning Department on the Official Plan Amendment that affects the above property. The only concerns raised at that time concerned providing a 200 foot separation between the subdivision and an apple orchard to the south. We note the Plan of Subdivision incorporates this building restriction, and therefore, have no objections to the proposed Plan of Subdivision." Central Lake Ontario Conservation Authority "Your request for comments on the above-noted draft plan of subdivision is hereby acknowledged. The plan to which we refer proposes 17 lots and is dated January 22, 1985. The Authority staff have no objectjion to the approval of the above subdivision provided the following conditions are included in the conditions of approval . 1 . A deposit is to be registered against the titles of Lots 14, 15 and 16 stating that there shall be no alteration to live vegetation without prior Authority approval . The Authority staff is to receive a certified true copy of this deposit prior -to the start of construction on these lots. 2. No filling or grading is to occur on the site without prior Authority approval . 3. The subdivision agreement is to contain the above conditions." . . .4 I REPORT NO. : PD-61-85 Page 4 Region of Durham Works Department "The Regional Works Department has reviewed the above-noted draft and wish to provide comments as follows: Municipal water supply and sanitary sewer services are not available to the subject land and the Regional Works Department has not plans within its capital budget to extend said services into this particular area of the Town of Newcastle. Therefore, individual wells and private waste disposal would appear to be the only available method of servicing. With respect to the abutting Regional Road, we wish to request a 3.048m road widening on the total frontage of the plan abutting Road 57 and a 0.3048m reserve on the frontage of this plan except Lot 17 on Road 57. In view of the fact that the proposal will proceed with private servicing as indicated in this submission, we have no objection to further processing of this draft plan. The following Municipality of Durham Works Department conditions shall be complied with prior to consent by the Works Department for registration of the plan of subdivision and said conditions shall form part of the Subdivision Agreement: a) That the subdivider pay for those service charges and development charge levies which are in effect at the time of registration of any portion of this plan. Said service charges shall pertain to those services which are the responsibility of the Regional Municipality of Durham. b) That the Owner agrees in writing to satisfy all the requirements, financial and otherwise, of the Region of Durham concerning the provision of roads and other Regional services. c) That a 3.048m road widening on the total frontage of the subject plan abutting Regional Road #57 as marked in red on the attached plan, be dedicated, free and clear of all encumbrances, to the Regional Municipality of Durham. d) That a 0.3048m reserve on the frontage of the subject plan abutting Regional Road #57, except Lot 17, as marked in green on the attached plan, be dedicated, free and clear of all encumbrances, to the Regional Municipality of Durham." Town of Newcastle Fire Department "The Fire Department has no objection to the above-headed application. This development is located approximately three miles from Fire Station #1 , Bowmanville, an acceptable travel distance and response time for fire emergency services. . . .5 REPORT NO. : PD-61-85 Page 5 -� Town of Newcastle Fire Department (Cont'd) Water is supplied to this area by fire department tank truck. Consideration should be given to Fire Protection Requirements for Rural Development, PD Report 40-84. " Town of Newcastle Community Services Department "In response to your letter of February 11, 1985 regarding the subject in question. Recommend 5% in lieu of cash for parkland. " Town of Newcastle Works Department "We have reviewed the above-noted plan of subdivision and submit the following comments: 1 . That all works are completed in accordance with the Town of Newcastle 's Design Criteria and Standard Drawings; 2. That any easements required by the Town be granted free and clear of any encumbrances; 3. That the 3.048 metre road widenings, sight triangles, and 0.3 metre reserve as shown on the draft plan be dedicated to the Town; 4. That a road widening on Lot 16, as shown in red on the attached plan, be dedicated to the Town; 5. That the utility distribution on the cul-de-sacs (Hydro, Bell , Cable TV, etc. ) be installed underground (both primary and secondary services) ; 6. That the owner's consultant establishes a road and ditch grade for Old Scugog Road and that the overall drainage plan is incorporated in the design of same; 7. That the owner meet all the requirements of the Public Works Department, financial or otherwise; 8. The developer should be required to pay for 50% of cost of reconstructing Old Scugog Road to a 2-lane Rural Standard; 9. That the owner enter into a Development Agreement with the Town, and that this department be kept informed of the status of same at all times; 10. The developer should be required to provide street lighting along Old Scugog Road and the cul -de-sac; 11. All of the other standard requirements re: Lot Grading, Schedules of Works, Performance Guarantees, Costs Estimates, etc. , should be included in the Subdivision Agreement. " . . .6 REPORT NO. : PD-61-85 Page 6 i STAFF COMMENTS: With respect to the comments of the Fire Department, Staff have incorporated within the list of draft conditions of approval that the Owner covenants and agrees to negotiate with the Town an appropriate contribution for fire protection purposes. Staff would note for Committee's information that in consideration of the estate development on the west side of Old Scugog Road (26 lots) for which a fire protection contribution was received, a similar provision would be appropriate. The Works Department had no objection to the plan in consideration of the comments as noted earlier in this Report. The plan, however, has been revised to incorporate the road widening abutting Lot 16. In consideration of the comments received and contained within the conditions of draft approval on Attachment No. 1 to this report, Staff forwards same for Committee and Council 's consideration. That this approval shall apply to draft plan of subdivision 18T-85002, prepared by Donevan & Fleischman, identified as Job No. 1 -5708, dated January 22, 1985, which is revised in red as per the attached plan showing seventeen (17) single family lots. 2. That the developer enter into a Subdivision Agreement with the Town of Newcastle. 3. That the Owner grant to the Town, free and clear of all encumbrances, all easements and dedications as requested. 4. That the Owner agrees to pay to the Town of Newcastle, the cash value of the five percent (5%) parkland dedication in lieu of the parkland. 5. That the works be designed and constructed in accordance with the latest Town of Newcastle design criteria and standards. 6. That the road allowances included in this draft plan be dedicated as public highways. 7. That the road allowances in the plan be named to the satifaction of the Town of Newcastle and the Regional Municipality of Durham. 8. That the Owner agrees to satisfy all other requirements of the Town of Newcastle, financially and otherwise. 9. That the necessary amendment to By-law 84-63, as amended, of the Town of Newcastle, be approved and in effect. 10. That the Owner agrees, in writing, to satisfy all requirements, financial and otherwise, of the Region of Durham. 11. That the Owner agrees to contribute to the Town of Newcastle 50% of the cost for the reconstructing of Old Scugog Road to a two-lane rural standard; abutting said lands. 12. That the Owner dedicate the appropriate property to the satisfaction of the Town of Newcastle for road widening purposes, free and clear of all encumbrances along the frontage of Old Scugog Road abutting said lands. 13. That the Owner dedicate the appropriate property to the satisfaction of the Town of Newcastle for 0.3 metre reserves, being Blocks 19, 20 and 21 , free and clear of all encumbrances. . . .2 Page 2 ATTACHMENT NO. 1 TO REPORT PD-61-85 TOWN OF NEWCASTLE CONDITIONS OF DRAFT APPROVAL SUBDIVISION APPLICATION 18T-85002 14. C--7 0, 4(Z THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 85- being a By-law to authorize the entering into of an Agreement with 464367 Ontario Limited and the Corporation of the Town of Newcastle. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, an Agreement between 464367 Ontario Limited and the said Corporation dated the day of 1985, in the form attached hereto as Schedule "X". 2. THAT Schedule "X" attached hereto forms part of this by-law.
