RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-62-85 be received for
information.

BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration
Committee, staff have prepared the attached list of applications
to the Committee of Adjustment for the meeting of March 27
1985 . This list includes the file number, applicants name,
site location, type of variance requested, Official Plan
Conformity, By-law Conformity, staff' s comments on the
applications and the Committee of Adjustment' s decision.

APPLICATIONS:
A 4/85 - L. Jean Stevens, Part Lot 13 & 14, Concession 1 , Bowmanville.
Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot with a frontage of 16.75 m on an
improved public street, instead of the required 40 m frontage.
Mr. Bob Stevens appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by A. Reicheld, seconded by T. Rehder,
"THAT as the proposed variance would appear to be
in keeping with the intent of the Official Plan
and Zoning By-law # 84-63 and as the present shortage
in the frontage of the lot was due to a recent
partial closing of the road allowance, permission
is GRANTED to create a lot with a frontage of 16.75 m.
This approval is conditional upon final approval of
Zoning By-law No. 84-63. "

Application was made for relief from zoning by-law requirements in order
to permit the applicant to construct a single family dwelling, leaving
a front yard of 10.66 m and a rear yard of 10.66 m.
Mr. Bob Stevens appeared in supprot of this application. No other
person appeared in support of or in opposition to this application.
Moved by J. P. Murdoch, seconded by A. Reicheld,
"THAT as the requested variance would be keeping
within the intent of the Official Plan and Zoning
By-law and, due to the depth of the lot, would
make it difficult to meet both front yard and rear
yard requirements and as the construction site has
been approved by C.L.O.C.A. , permission is GRANTED
to construct a single family dwelling, leaving a
front yard of 10.66 m and a rear yard of 10.66 m
conditional upon final approval of Zoning By-law
84-63 and Central Lake Ontario Conservation Authority. "

Application was made for relief from zoning by-law requirements in order
to permit the applicant to use a lot with a frontage of 14.48 m, instead
of the required 15 m frontage.
Mr. Bill Ormesher appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by A. Reicheld, seconded by J. P. Murdoch,
"THAT as the proposed variance does not offend the
intent of the Official Plan or Zoning By-law and would
not appear to have a detrimental effect on the
surrounding properties, permission is GRANTED to
use a lot with a frontage of 14.48 m on condition
that all other zoning requirements are met. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 884 sq. ft. accessory
building, instead of the required 'not more than 40% of the main
building total floor area' .
Mr. McBride appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by J. P. Murdoch, seconded by T. Rehder,
"THAT as the proposed accessory building appears
to comply with the intent of the Official Plan
and as the area of the building will only be
greater than the By-law requirements by 8.3%,
the variance is considered to be minor in nature
and permission is therefore GRANTED to construct
a 884 sq. ft. accessory building."

A 8/85 - Thomas J. Wilson, Lot 15,. Concession_ 6, . Darlington
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to a legal
non-conforming single family dwelling located in an Environmental
Protection Zone.
Mr. Wilson appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by J. Payne, seconded by T. F. Rehder,
THAT as the proposed addition does not appear to
offend the intent of the zoning by-law and would not
have a detrimental effect on the surrounding properties,
permission is GRANTED to construct an addition to a
legal non-conforming dwelling in an Environmental
Protection Area, conditional upon final approval of
the Central Lake Ontario Conservation Authority. "

Application was made for relief from zoning by-law requirements in order
to permit the applicant to create a lot with an existing single family
dwelling having a rear yard of 6 m, instead of the required 7.5 m rear
yard.
Ed Vanhaverbeke appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by T. H. Rehder, seconded by J. P. Murdoch,
"THAT as the proposed variance would not offend the
intent of the Official Plan or Zoning By-law and would
not appear to have a detrimental effect on the surrounding
properties and as this rear yard will become a front yard
with a required yard of 6 m in the proposed plan of
subdivision, permission is GRANTED to create a lot with
an existing single family dwelling having a rear yard
of 6 m. This approval is conditional upon the addition
at the rear of the house being removed within 12 months of
the date of the approval or prior to the finalizing of
the severance, whichever occurs first. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to an existing
single family dwelling leaving a side yard of 3.2 m, instead of the
required 1 .2 m on one side and where there is no attached garage or
carport 4.5 m side yard on the other side.
Mr. Rivers appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by J. P. Murdoch, seconded by J. Payne,
THAT as the proposed variance would not appear to
offend the intent of the Official Plan or Zoning By-law
and as the narrow side yard is much greater than
required, the variance would not appear to have a
detrimental effect on the surrounding area and
permission is GRANTED to construct an addition with
a side yard of 1 .2 m on one side and 3.2 m on the
other side. "

A 11/85 _ John A. Lewis, Part Lot 11 , Concession 1 , Bowmanville.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to an existing
commercial building leaving a side yard of 1 ft. ( .3m) , instead of the
required 1 .25 m side yard.
Carol Alder, Warren Alder and Ken Sloan were present with interest in
this application. No other person appeared in support of or in
opposition to this application.
Moved by J. P. Murdoch, seconded by A. Reicheld,
THAT the proposed addition would not appear to
offend the intent of the Official Plan or Zoning
By-law and would not appear to have a detrimental
effect on the surrounding as-ea. Due to the irregular
shape of the lot and as the proposed addition will
not be closer than the existing building, permission
is GRANTED to construct an addition leaving a side
yard of 1 foot ( .3m) . "

"THAT the minutes of the last meeting be approved
as circulated. "
