SUBJECT: PROPOSED AMENDMENT TO DURHAM REGIONAL OFFICIAL PLAN
REGARDING SPECIAL POLICY AREAS FOR FLOODPLAIN
MANAGEMENT - FILE: 85-13/D
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-63-85 be received; and
2. That the Region of Durham be advised that the Town of
Newcastle has no objection to the proposed amendment
to the Durham Regional Official Plan to incorporate a
policy with respect to the designation of "Special
Policy Areas" or "Flood Damage Centres" in flood
susceptible areas.

BACKGROUND:
On March 13, 1985, Regional Council directed Regional Staff to
proceed with an amendment to the Regional Official Plan with regard
to flood susceptible areas. Accordingly, on March 18, 1985, the
Region advised the Town of the proposed amendment and requested
* comments on same. The proposed amendment (attached), as prepared
by Regional Staff, would enable area municipalities to incorporate
specific detailed policies and designations regarding Special
Policy Areas on flood prone lands in their local official and/or
district plans.
This amendment has been proposed in response to the Provincial
Government's floodplain management policy which provides for the
designation of Special Policy Areas. The policy states that where
strict application of flood regulations is not feasible, Special
Policy Areas within flood plains may be recognized and controlled
development permitted. A higher than normal degree of flood risk
is accepted, and the Conservation Authority uses a lower standard
of protection when considering applications for construction or the
placing of fill . The intent of this policy is to permit existing
built-up or urbanized areas located within floodplains to be
recognized and to permit the expansion and enlargement of existing
uses within such areas.
COMMENT:
Council has already considered the possible designation of Special
Policy Areas within the Town. In February, 1983, Central Lake
Ontario Conservation Authority requested the Town to define any
areas within the municipality which would warrant special
recognition as Special Policy Areas. Staff reviewed -the floodplain
mapping for all of the urban areas and hamlets within the Town,
including those within the Ganaraska Region watershed. Staff found

that, in general , there is very little urban type development
within floodplain lands, and recommended to Committee on May 16,
1983 (Staff Report PD-77-83) that Central Lake Ontario Conservation
Authority be advised that there are no areas within the Town which
would qualify as Special Policy Areas. Committee and Council
subsequently endorsed this recommendation.
Although there do not appear to be any areas within the Town which
would warrant special consideration as Special Policy Areas, Staff
have no objection to the proposed amendment inasmuch as it states
that such areas, as well as Flood Damage Centres, are to be
designated in the Official Plan of the respective area
municipality. This provides the Town with the flexibility to
designate such areas at a later date should a more detailed review
indicate that such a designation is warranted in a particular area.
As well , Staff note that portions of the Ajax District Plan and the
Pickering District Plan have been deferred pending resolution of
this issue.
It is therefore recommended that the Region of Durham be advised
that the Town of Newcastle has no objection to the proposed
amendment to the Regional Official Plan regarding the designation
of Special Policy Areas in flood prone areas.

PROPOSED AMENDMENT TO THE DURHAM REGIONAL OFFICIAL PLAN

PURPOSE : The purpose of this Amendment to the Durham Regional Official Plan
is to incorporate a policy which would allow respective area
municipalities to permit development in the flood plain subject to
a certain procedure being followed.
BASIS: The Provincial Government has adopted "Guidelines for Flood Plain
Management Policies in Ontario". The proposed amendment is in
accordance with these guidelines.
ACTUAL
AMENDMENT: The Durham Regional Official Plan is hereby amended by adding the
following new section 1 .2.20:
"1.2.20 The Provincial Flood Plain Management Policies generally
indicdate that no development or redevelopment will be
permitted below the Regulatory Flood. However, these
policies make provision for the application of a Special
Policy Area or Flood Damage Centre designation for those
areas where it is deemed appropriate in the public
interest, by the Province, the Region, the respective
area municipality and the respective Conservation
Authority, to assume a higher degree of flood risk than
that which would normally be acceptable elsewhere. Such
Special Policy Areas or Flood Damage Centres must be
designated in the official plan of the respective area
municipality. In addition, the respective area municipal
Councils are encouraged to incorporate policies in their
respective official plan which would
a) provide specific minimum development standards; and
b ) indicate methods of implementation.
Such designations and policies will be prepared in
consultation with the respective conservation
authority. "
