REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING

SUBJECT: EXTENSION OF DRAFT PLAN APPROVAL
FILES: 18T-76048 and 18T-76027
COURTICE HEIGHTS DEVELOPMENTS LIMITED
PART LOTS 31 & 32, CONC. 2, FORMER TWP. OF DARLINGTON
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-74-85 be received; and
2. That Council adopt the following resolution:
"That the correspondence form Ronald K. Webb,
Q.C. dated April 17, 1985, be received and the
Ontario Municipal Board be advised that the
Corporation of the Town of Newcastle has no
objections to the extensions to the draft plan
approval of Plans 18T-76048 and 18T-76027 to June
12, 1986"; and
3. That the request in 2 above, be forwarded to the
Ontario Municipal Board, and that Courtice Heights
Developments Ltd. be so advised.

BACKGROUND AND COMMENTS:
* A copy of the attached letter was received by the Planning and
Development Department on April 22, 1985. The letter, jointly
addressed to the Region of Durham and the Town of Newcastle, from
Mssrs. Davis, Webb, Barristers & Solicitors on behalf of Courtice
Heights Developments Limited, requests approval of an addition one
(1 ) year extension in draft approval of Subdivision 1817-76027,
located in Part of Lots 31 and 32, Concession 2, former Township of
Darlington. The purpose for the requested extension is to enable
the developers to negotiate the required Subdivision Agreements
with the Region and to allow for additional time in order to
satisfy the various conditions of draft plan approval .
In that regard, Staff would note that the Subdivision Agreements
between the Town of Newcastle and Courtice Heights (South and
North) have been registered on title (September 22, 1983 and May 8,
1984) and would therefore, have no objection to the one (1 ) year
extension of draft plan approval 18T-76027 to June 12, 1986.
Mr. Webb advises that his client is in the process of signing the
subdivision agreement with the Region with respect to the southern
subdivision (18T-76027) but does not anticipate that it will be
able to complete registration prior to the expiration of draft plan
approval on June 12, 1985. With respect to the northern
subdivision, the alignment of the storm sewer is presently being
redesigned.
In consideration of the above-noted comments, Staff would have no
objections to the extension of draft plan approval for a further
twelve (12) months (June 12, 1986) with respect to each plan;

Our client advises that it is in process of signing the subdivision
agreement with the Region with respect to the southern subdivision,
but does not anticipate that it will be able to complete regis-
tration prior to the expiration of draft plan approval on June 12 ,
1985. It will therefore require an extension of draft plan approval
for a further 12 months.
With respect to the northern subdivision, the Town's engineers are
currently working on the design for the realignment for the storm
sewer. These matters will not be completed prior to June 12, 1985
and therefore an extension of draft plan approval will be required
with respect to this subdivision as well.
Would you please write to the Ontario Municipal Board (with a copy
Of your letter to us for our files) consenting to the extension of
draft plan approval for a further 12 months with respect to each
file.
