SUBJECT: REZONING APPLICATION - 464367 ONTARIO LIMITED
PART OF LOT 15, CONC. 3, FORMER TWP. OF DARLINGTON

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-80-85 be received; and
2. That application for rezoning DEV 85-6 in respect of
Lot 15, Concession 3, former Township of Darlington,
* be approved and that the attached by-law to amend
Zoning By-law 84-63, as amended, be forwarded to
Council .

BACKGROUND AND COMMENTS:
On March 28, 1985, the Planning Department received an
application, submitted by W. B. Craig on behalf of 464367 Ontario
Limited to rezone a parcel of land located in Part of Lot 15,
Concession 3, former- Township of Darlington. The submission of
the rezoning application is an acknowledgement of previous
applications submitted for-, both, an amendment to the Durham
Regional Official Plan (OPA No. 126) and an approval of draft plan
of subdivision (18T-85002) for- an estate r•es i denti al development.
Staff would note, for- Committee's information, that Official Plan
Amendment No. 126 to the Official Plan for- the Regional
Municipality of Durham Planning At-ea, was approved by the Mi ni str-y
of Municipal Affairs and Housing on March 8, 1985. In addition,
Council , at their- meeting on Apt-i1 22, 1985, endorsed the
recommendations in Report PD-61-85, recommending draft approval of
Plan 18T-85002, as revised in r-ed, and subject to the conditions
contained in Attachment No. 1 to said r•epor•t.
In accordance with departmental procedures the subject application
was circulated to obtain comments from other- departments and
agencies. Inasmuch as the appr-opt•iate recommendations/r•equire-
ments of var-ious agencies and departments were i ncor•por•ated within
Staff Report PD-61-85 r-e: subdivision approval , the following had
no objections to the rezoning application as submitted:- Ministry
of the Environment, Mi ni str•y of Agri cul tune and Food, Region of
Durham Health Unit, Regional Planning Department, Town of
Newcastle Fire Department, Town of Newcastle Community Services,
and Town of Newcastle Works Department. Staff would note that
with respect to the Mi ni str•y of Agri cul tur•e and Food comment,
per-tai ni ng to a 200 foot setback from the or-char-d to the south of
the subject lands, the amending by-law incor•pot-ates such a
provision by rezoning that portion within 200 feet within an
"Environmental Protection" zone.

In consideration of the above-noted comments, Staff would have no
* objection to the approval of the amending zoning by-law, attached
hereto, implementing the Plan of Subdivision 18T-85002, and
Official Plan Amendment No. 126 to the Region of Durham Official
Plan.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 85-
being a By-law to amend By-law 84-63, as amended, of the Town of
Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63 of the Corporation of the Town of
Newcastle.
NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as
follows:
1. Schedule "1" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "A-Agricultural" to
"RE-3-Residential Estate Exception (RE-3)" and "EP-Environmental
Protection" zone, as shown on the attached Schedule "X" hereto.
2. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning
Act.
