SUBJECT: APPLICATION FOR REZONING - M. SENYK
PART LOT 35, CONCESSION 4, DARLINGTON
FILE: DEV 85-3
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-82-85 be received; and
2. That Application for rezoning DEV 85-3 be tabled
pending receipt of the Ontario Municipal Board
decision in respect of By-law 84-156; and
3. That the Region of Durham be advised of Council 's
actions regarding the subject application.

BACKGROUND AND COMMENT:
On February 13, 1985, the Planning Department received an
application, submitted by Mr. Michael Senyk, to rezone a parcel of
land located in Part of Lot 35, Concession 4, former Township of
Darlington. The submission of the rezoning application is to
permit the development of a node/cluster.
The application has been circulated to various agencies and Town
Departments for comment. The following departments, in reviewing
the proposal , provided no objections to the proposal :
i ) Town of Newcastle Fire Department
ii ) Ontario Hydro
iii ) Region of Durham Health Unit
iv) Ministry of Agriculture and Food
v) Town of Newcastle Works Department
Staff would note the Works Department, in offering no objection,
indicated that as Concession Road No. 4 is an Arterial Type 'A'
road in the Region of Durham Official Plan, and if approved, a
8.23 metre (27 feet) road widening is to be dedicated to the Town
for the frontage of the subject lands. Secondly, a lot grading
plan is to be prepared and provided for Staff's approval in
conjunction with an application for access permits.
The Region of Durham Planning Department responded. . . .
"that the subject property is designated "Major Open
Space" in the Durham Regional Official Plan. Limited
non-farm residential dwellings may be allowed in the form
of infilling within this designation. Section 10.2.1 .4
where one or more non-farm residential dwellings are to be
located between two buildings located on the same side of
a public road and within a distinct node or, cluster of
non-farm residential dwellings in such a manner, as not to
contribute to strip or ribbon development and subject to
such a node or cluster being identified in the respective
zoning by-laws.

From out, nevi ew of the assessment maps and aerial
photographs of the area, the subject property does not
appear, to e located within a distinct node or, cluster, of
non-farm residential dwellings and therefore, would not
conform to the Durham Regional Official Plan.
We note also that the proposal does not appear, to meet the
Town's cri ter,i a for, identifying rural nodes or, cl uster,s as
adopted by your, Council on January 28, 1985. . . ."
Rural nodes and clusters ar•e defined within the Town's criteria as
"areas of r,ur,al non-farm related residential development which
exhibit similar, lot char•acter,i sti cs and contain a minimum of three
(3) and a maximum of six (6) existing residential lots for which
building permits would be available and within which infilling may
occur up to a maximum of three (3) additional lots. A r,ur-al
cluster, shall be defined as areas bounded on, at least, three (3)
sides by natural or, physical boundaries such as water, courses or,
public streets."
Inasmuch as the application submitted does not conform with the
Region of Durham Official Plan and policies thereof, nor, the
Town's present cri ter,i a for, identifying nodes or, cluster's, Staff
ar,e not in a position, at this time, to recommend approval of the
application for rezoning submitted by Mr,. Senyk. We note,
however,, that on March 18, 1985 the Ontario Municipal Board held a
hearing in respect of By-law 84-156, being a zoning by-law to
define a rural node or, cluster. The Board decision has not yet
been received and inasmuch as that decision could have a bearing
on this application, Staff ar,e suggesting tabling. At such time
as the decision is received, a further, r,epor,t will be pr,epar•ed in
respect of this proposal .
