SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF MAY 8, 1985
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-86-85 and the minutes of the
Committee of Adjustment meeting of May 8, 1985
be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of May 8, 1985. This list includes the file number,
applicant's name, site location, type of variance requested,
Official Plan conformity, By-law conformity, staff's
comments on the applications, and the Committee of
Adjustment 's decision.

APPLICATIONS:
A 14/85 - Keith G. Kelly, Lot 10,_ Concession. 2, . Bowmanville.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 520 sq. ft, accessory
building which would exceed the maximum requirement of not more
than 40% of the main building total floor area.
Mr. Keith Kelly appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Reicheld, seconded by Mr. Murdoch,
"THAT as the proposed variance would not appear to
offend the intent of the Zoning By-law or Official
Plan and would not appear to have a detrimental
effect on the surrounding neighbourhood, the
variance of 18% could be considered minor, therefore
the variance is GRANTED to construct a 520 sq. ft.
accessory building which will exceed the 40% of the
main building total floor area."

A 15/85 - Robert H. Hibben, Lot 14, Concession 1 , Bowmanville.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an accessory building
leaving a 2 ft. side yard and a 2 ft. rear yard, instead of the
required 1 .2 m (4 ft. ) side and rear yard.
Mr. and Mrs. Hibben appeared in support of this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mrs. Payne, seconded by Mr. Rehder,
"THAT as the construction of the proposed accessory
building would not appear to offend the intent of
the Zoning By-law or Official Plan or have a
detrimental effect on the surrounding area,
permission is GRANTED to construct an accessory
building with a 2 ft. side yard and a 2 ft. rear
yard. "

A 16/85 - Joseph Schwarz and Carl Schwarz - Lot 12, Conc._ l ,_ Bowmanville.
Application was made for relief from zoning By-law requirements in
order to permit the applicant to reconstruct a non-conforming
dwelling, that was destroyed by fire, in an Environmental Protection
Zone.
Mr. J. Schwarz and Carl Schwarz and a number of surrounding
property owners appeared in support of this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mr. Muir, seconded by Mr. Murdoch,
"THAT as the proposed variance appears to conform
with the provisions of the Official Plan and Zoning
By-law and would not have a detrimental effect on
the surrounding area, permission is GRANTED to re-
construct a single family dwelling, that was de-
stroyed by fire. If during construction, the
existing foundation was found to be in an unsafe
condition, permission is also GRANTED to restore
the foundation to a safe condition. This approval
is conditional upon approval of C.L.O.C.A. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an attached garage
leaving an exterior side yard of 14.5 ft. (4.4 m) , instead of the
required 6 m exterior side yard and a 20 ft. (6m) rear yard,
instead of the required 7.5 m rear yard.
Mr. Tom Greer appeared in support of this application. No other
person . appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Muir,
"THAT as the proposed variance would appear to
comply with the provisions of the Official Plan
and Zoning By-law and would not appear to have
a detrimental effect on the surrounding area and
due to the shape of the lot would not effect
sight lines and could be considered minor,
therefore, permission is GRANTED to construct
an attached garage with a 4.4 m exterior side
yard and a 6 m rear yard. "

A 18/85 - Halminen Homes. Ltd. , Lot_ 34,_Concession. 3,_ Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a single family dwelling
leaving a 4. 16 m side yard, instead of the required 6 m side yard.
Mr. H. Halminen appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mrs. Payne,
THAT as the proposed variance does not appear to
offend the intent of the Official Plan or Zoning
By-law or have a detrimental effect on the
surrounding neighbourhood and due to the irreg-
ular shape of the lot could be considered minor
in nature, permission is GRANTED to construct a
single family dwelling leaving a 4. 16 m exterior
side yard. "
