RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-118-84 be received; and
2. That By-law 84-59 be forwarded to the Ontario
Municipal Board for approval .

BACKGROUND AND COMMENTS:
On April 24, 1984 Council approved By-law 84-59. The
purpose and effect of said by-law was to rezone a 3.66 ha
(9.04 ac) parcel of land on High Street in Bowmanville from
"R" - General Residential to a special provision residential
zoning to implement one of the conditions of approval for
draft plan of subdivision 18T-74067. Said subdivision was
originally approved on August 5, 1980 and a subsequent
revision to the plan approved by the Ministry of Housing on
January 23, 1984. This revision dealt with the location of
the access road and the requisite changes to lot layout.
By-law 84-59 was circulated by the Clerk in accordance with
Provincial regulations. In response to this circulation one
letter of objection and two letters of support were
received.
The objector's letter indicated his objection was submitted
on behalf of him and his wife and two neighbouring families.
The letter of objection did not detail the nature of the
objection. However, past discussions with staff and
representations to Council clearly indicated that the
objection was in respect of the proposed road pattern and
not the zoning of the lands. The subdivision design has, in
fact , been established through draft approval of the plan
which the Town is satisfied with.
The zoning of the land is presently "R" - General
Residential and the rezoning required to recognize smaller
lot sizes and setbacks from the existing rail line. The

road location and design is not germaine to the zoning
issues but cerainly would affect zone boundaries which
relate, to a certain extent, to road patterns.
The two letters of support speak to the road location in one
instance and land use in the other. Copies of all letters
are attached for the Committee's information.
Staff have reviewed the objection received and note that the
By-law implements a condition of draft plan approval . In
staff' s opinion, By-law 84-59 should be forwarded to the
Ontario Municipal Board for approval notwithstanding the
objections submitted.

- It will clear up once and for all the uncertainty
concerning the use of this land.
- The sewer extension for the proposed subdivision will
alleviate tho sewer back-up problem on High Street.
- The subdivision will fill vacant land which at this time
is not looked after.

Dear Mr. Oakes :
With regard to 'Zoning By-law 84-59 and the development of a subdivision
'-n our neighbourhood ; We understand that three local residents have made
objection to the plan to the Ontario Municipal Board. We are familiar with
the plan and while objection to the location of the road approaching High
Street is understandable, we believe it is not well founded and short-sighted.
We believe that improvements planned by the developer far outweigh the
objection and will mean progress for the neighbourhood and for the Town of
Newcastle.
Please convey our feelings to the O.M.B. as we hope this plan will meet
With their early approval.
