SUBJECT: BY-LAW 84-5 AMENDING FORMER TOWNSHIP OF
DARLINGTON ZONING BY-LAW 2111
PLAN OF SUBDIVISION - 18T-77001
SCHLEISS AND HOLLAND (KILIMANJARO INVESTMENTS
AND NEWGOR LAND GROUP)
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-119-84 be received; and
2. That the attached by-law, being a by-law to
amend By-law 2.111, as amended, in respect of
Lot 34, Concession 3, geographic Township of
Darlington, be approved

BACKGROUND AND COMMENTS:
As noted within Staff Report PD-101-84, a request was made
that consideration be given to the amending of the lot area
and frontage requirements for a number of lots within the
Urban Residential Type 1 (R1 ) and Urban Residential Type 2
(R2) zones as contained within amending by-law 84-5. It was
staff's understanding that in preparing the final plan, the
applicant 's consultant encountered difficulties in complying
with the provisions of by-law 84-5. In consideration of the
fact that the engineering and survey plans for proposed
phase 1 have been completed, a request to amend the lot area
and frontage requirements was initiated. With regard to
lots within subsequent phases of development, that may not
meet the by-law requirements, it was suggested that the
draft plan be altered slightly (minor lot line adjustments)
to bring it into conformity with by-law 84-5.
Within the area designated for phase 1 development, there
are 46 (R1) single family lots that are 15 square metres
below the required area of 465 square metres, and 1
additional lot 17 square metres below the minimum. In
consideration of the minimum lot frontage requirements
within the (R1) zone, a reduction in lot areas for the
affected lots would represent a decrease in lot depth of
approximately 1 metre from 31 metres to 30 metres.
Additionally, in the (R2) zone there are 12 (R2) lots that
are 4 square metres below the required area of 370 square
metres. This would represent a reduction in the lot depths

of .40 metres (1 .31 feet) .
The subject application was circulated in accordance with
departmental procedures and the comments received did not
contain any objections to the proposed amendment, as the
general intent of By-law 84-5 was being maintained. Staff
would note for the Committee's information, that discussions
with the consultant included consideration of a number of
alternatives for complying with By-law 84-5. Based upon

these diUssions nothing short of a major re-design to the
draft plan would be possible. Staff would concur that in
consideration of the nature of the amendment requested, the
reduction in lot areas and corner lot frontages is minor and
the approval of a zoning by-law amendment a practical avenue
for resolving the non-compliance without incurring
substantial costs and creating further delays to the
registration of the subject plan.

BY-LAW NUMBER 84- 91
being a By-law to amend By-law 2111 , as amended, of the former
Township of Darlington, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 2111, as amended, of the former Township
of Darlington, now in the Town of Newcastle.
NOW THEREFORE, the Corporation of the Town of Newcastle enacts as
follows:
1 . Section 13(vv) of By-law 2111 , as amended, is hereby further
amended by adding thereto the following subsection 1(iii)(a)(x)
immediately following subsection 1(iii)(a)(ix):
1 (iii)(a)(x) SPECIAL EXCEPTIONS - URBAN RESIDENTIAL TYPE ONE (Rl)
ZONE
i) Notwithstanding the provisions of Section l(iii)(a)
"Zone Provisions - Urban Residential Type One (1)
Zone"; those lands designated as "R1-11" on Schedule
"X-1" to this By-law shall be subject to the following
provisions:
a) lot area (minimum) 445 square metres
b) lot frontage (minimum)
exterior lot 16 metres
2. Section 13(vv) of By-law 2111, as amended, is hereby further
amended by adding the following subsection 1(iii)(b)(ix) immediately
following subsection l(iii)(b)(viii):
"l(iii)(b)(viii) SPECIAL EXCEPTIONS - URBAN RESIDENTIAL TYPE TWO (R2)
ZONE
i) URBAN RESIDENTIAL EXCEPTION R2-1
Notwithstanding the provisions of Section l(iii)(b)
"Zone Provisions - Urban Residential Type Two(R2)
Zone"; those lands designated as "R24' on Schedule
"X-1" to this By-law, shall be subject to the
following zone provisions:
a) lot area (minimum) 365 square metres
3. Schedule 1-1" to By-law 84-5; amending By-law 2111 , is hereby
amended by deleting Schedule 1-1" and substituting the attached
Schedule "X-1" hereto.
4. Schedule "X-1" to By-law 84- 91 shall form part of this
By-law.
5. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 34 of The Planning Act.
BY-LAW read a first time this 9th day of July 1984.
BY-LAW read a second time this 9th day of July 1984.
BY-LAW read a third time and finally passed this 9th day of
July 1984.
