SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF JUNE 6, 1984
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-127-84 and the minutes of the
Committee of Adjustment meeting of June 6,
1984 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and
Administration Committee, staff have prepared the attached
* list of applications to the Committee of Adjustment for the
meeting of June 6, 1984. This list includes the file number,
applicant' s name, site location, type of variance requested,
staff's comments on the applications, and the Committee of
Adjustment's decision.

APPLICATIONS:
A 39/84 - Pauline & Ian Wilson, Lot 13, Concession 1 , _ Bowmanville.
Application was made for relief from zoning by-law requirements in order
to permit the applicant to construct a deck to the existing single family
dwelling, leaving a rear yard of 19.5 feet, instead of the required
35 ft. rear yard.
Ian Wilson appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Muir, seconded by Mr, Murdoch,
"THAT as this variance appears to conform to the
Official Plan and Zoning By-law and would not appear
to have a detrimental effect on the abutting properties
and is considered minor in nature, permission is
GRANTED to construct a deck at the rear of the existing
single family dwelling, leaving a rear yard of 19.5 ft.
(5.9 m)"

Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an addition to the existing
church building, maintaining the existing non-conforming 0 front yard
and 3.5 ft. side yard, instead of the required 25 ft. front and side
yard.
No person appeared in support of or in opposition to this application.
Moved by Mr. Yellowlees, seconded by Mr. Muir,
"THAT as .the requested variance would be keeping
within the intent of the Official Plan and Zoning
By-law and could be considered minor in nature as
they are not encroaching further into the non-
conforming yards, permission is GRANTED to construct
an addition to the existing church building, main-
taining the existing non-conforming 0 front yard
and 3.5 ft. side yard."

Application.was made for relief from zoning by-law requirements in
order to permit the applicant to install a 5 ft. high fence along a
portion of their property abutting Elgin St. , whereas the by-law
requires that no structure, hedge or obstruction of more than 2 ft.
6 in. in height be permitted within 10 ft. of the street line.
Mr. and Mrs. Parker appeared in support of this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mr. Rehder, seconded by Mr. Yellowlees,
"THAT as the proposed fence would not cause a
problem with sight lines at the intersection and
would not appear to have a detrimental effect on
the abutting properties, permission is GRANTED
to install a 5 ft. high fence along a portion of
the property line abutting Elgin Street."

A 42/84 - William and Eleanor Bennett, Lot 23, B.F. Conc. , Darlington
Application was made for relief from zoning by-law requirements in
order to permit the applicant to operate a Furniture Upholstery and
Furniture Repair Shop as a home occupation, being a similar use to
the woodworking shop as permitted in By-law 79-138.
Mr. Bennett appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Muir,
"THAT as*,the requested conversion of an existing home
occupation to one of a similar nattre would not appear
to offend the intent of the Zoning By-law or Official
Plan, permission is GRANTED to operate a Furniture
Upholstery and Repair Shop which is considered to be
of a similar nature to the "Woodworking Shop" which
is a permitted use under this Special Provision Zoning."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with a
front yard of 19.86 feet and a set back of 52.86 feet, instead of
the required 20 ft. front yard and 53 ft. set back.
No person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Reicheld,
"THAT as the requested variance does not offend the
intent of the Zoning By-law or Official Plan and
would permit the continued use of this property,
permission is GRANTED to continue the use of this
lot with a single family dwelling, having a front
yard of 19.86 feet and a set back of 52.86 feet. "

Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage of
20.76 m (68.13 ft. ), instead of the required 75 ft. frontage with
an existing single family dwelling thereon, having a legal non-
conforming front yard and set back and a garage having a legal non-
conforming side yard.
Lois Brown appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Rehder,
"THAT this variance appears to comply with the
provisions of the Official Plan and would permit
the applicant to sever a strip of land to be
added to the abutting property, permission is
GRANTED to create a lot with a frontage of 20.76 m
(68.13 ft. ) , instead of the required 22.9 m (75 ft. )
frontage, with an existing single family dwelling
having a non-conforming 3.9 m front yard and a 10.45 m
set back and an accessory building having a side yard
of .48 m. "

A 45/84 - Halminen Homes Limited, Lot 12, Concession 1 ,_Bowmanville.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a single
family dwelling, having a side yard of 1 .25 m, instead of the
required 1 .5 m side yard.
Paul Halminen appeared in support of this application. Mrs.
Koning appeared in opposition to this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mrs. Payne,
"THAT as the variance would not offend the intent of
the Official Plan or Zoning By-law and would permit
the continued use of this single family dwelling,
permission is GRANTED to continue the use of this lot
with a single family .dwp(lling having a side yard of
1 .25 m (4.10 ft. ) on condition that a plot plan
signed by an O.L.S. be submitted to the Director of
Public Works showing that the grading would not
adversely affect the water run-off on-the abutting
pr.•operties to the north.

Application was made for releif from zoning by-law requirements in
order to permit the applicant to construct an accessory building
in the front yard, leaving a 1 ft. front yard and a non-conforming
set back, instead of the required 20 ft. front yard, 16.2 m (53 ft. )
set back and being located wholly in the rear yard.
Mr. & Mrs. Peters appeared in support of this application. Mr. Fagan,
Mrs. Adegeest, J. Partridge, C. Hooey and P. Boyd appeared in
opposition to this application. No other person appeared in support
of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Reicheld,
THAT this application be deferred to the next meeting
of the Committee in order to acquire addition infor-
mation from Public Works with re6pect of drainage."
