SUBJECT: Application for Rezoning

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-129-84 be received; and
2. That the attached By-law to amend Zoning By-law
2111 , as amended, in respect of Part Lot 19 &
20, Conc. 7, Geographic Township of Darlington
be approved.

BACKGROUND AND COMMENTS
On April 16, 1984 and May 22, 1984 Committee considered
staff reports PD-74-84 and PD-112-84 respectively. At the
Council meeting of May 28, 1984 the matter was referred back
to staff for more discussion relative to road patterns.
In response to this directive, a third request for comments
was made of the Public Works Department and the Fire
Department. Their comments remain unchanged. On June 18,
1984 staff met with Mr. & Mrs. Nimigon to discuss the draft
approved plan and their concerns relative to road
alignments. Their position remains unchanged.
The subject application is in respect of the zoning of the
lands. The issue of road patterns has been dealt with
through draft plan approval . A change to the road pattern
would require a complete redesign and preparation of new
engineering drawings. It would also require approval of the
Regional Municipality of Durham. Staff do not feel such a
revision is necessary nor in the interests of the Town.
Staff sympathize with the concerns of Mr. & Mrs. Nimigon ,
however, when all other factors are taken into consideration
we must reaffirm our previous recommendations.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84-
being a By-law to amend By-law Number 2111 , as amended, of the former
Township of Darlington, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington, now in the Town of Newcastle.
NOW, THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1 . Section 13 of By-law 2111, as amended, is hereby further amended
by adding thereto the following subsection (ccc):
"(ccc) Part of Lots 19 & 20, Concession 7
Notwithstanding any provision of this By-law to the contrary
that Part of Lots 19 & 20, Concession 7, designated as
"SPECIAL PROVISION BY-LAW 84- If on the attached Schedule
"A" hereto shall only be used—Fn—accordance with the follow-
ing provisions. In the event that there is any conflict be-
tween the provisions of this Special Provision and any other
provisions of this By-law 2.111 , as amended,, then the provi-
sions of this Special Provision shall apply. But in the
event that this Special Provision is silent on any matter,
then the provisions of By-law 2111, as amended, shall apply.
The Block numbers cited herein refer to the Block numbers
identified on Schedule "X-1" hereto.
(i) Definitions
(a) Park, Greenbelt:
shall mean a public or private park, the main purpose of
which shall be the protection of open space areas and
natural watercourses, which may be used for recreational
activities including playing and athletic fields, but ex-
cluding any buildings or structures.
(ii) Permitted Uses
(a) Block 1 :
- Park, Greenbelt
- Flood and Erosion Control Works
(b) Block 2:
one single family dwelling per lot, and uses, buildings
and structures accessory thereto.

(iii) Zone Provisions
a. Lot Area (minimum) 0.8 hectares
b. Lot Frontage (minimum) 45 metres
C. Yard Requirements (minimum);
i) Front Yard 6 metres
ii) Exterior Side Yard 6 metres
iii) Interior Side Yard 2 metres
iv) Rear Yard 10 metres
d. Floor Area (minimum) 110 square metres
e. Lot Coverage (maximum) 30 percent
f. Landscaped Open Space (minimum) 30 percent
g. Building Height (maximum) 10 metres
2. Schedule "A" to By-law 2111 , as amended, is hereby further
amended by changing to "SPECIAL PROVISION BY-LAW 84- ", the zone
designation of the lands designated "SPECIAL PROVISION BY-LAW 84-_"
on the attached Schedule "X" hereto.
3. Schedules "X" and 1-1" attached hereto shall form part of said
By-law.
4. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 34 of the Planning Act, as amended.
