SUBJECT: APPLICATION FOR REZONING DEV 82-6
Part of Lot 2.2, Broken Front Concession
former Township of Darlington
Oshawa General Racing Pigeon Club
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-133-84 be received; and
2. That the attached amendment to By-law 2111 , as
amended, in respect of Lot 22, B.F.C. , file DEV
82-6 be approved; and
3. That the Clerk proceed with the requisite
notices in accordance with the provisions of
the Planning Act Chapter 379 RSO 1980 as
permitted by Section 74(6) of the Planning Act,
1983.

BACKGROUND AND COMMENT:
The subject application for rezoning requested an amendment
to By-law 2111 , as amended, of the former Township of
Darlington to permit the applicants to construct a club
house facility for the members of the Racing Pigeon Club as
dealt with by Committee at their May 17, 1982 meeting
(PD-85-82). Council at their May 25, 1982 meeting adopted
the following resolution :
"That application for rezoning Z-A-1-2-8,
Part Lot 22, B.F.C. , Darlington be approved
and the By-law be forwarded to Council for
approval at such time as the applicants submit
lot grading and drainage plans and receive
approval of same from the Director of Public
Works".
In consideration of the above, Staff would note that the
Works Department most recently received said plans for
review.
Comments with respect to the re-location of the existing
entrance to the southerly limits of the parking area; the
provision of an adequate security pertaining to the entrance
works and roadside restoration and the need for an access
permit were noted. Accordingly the Works Department would
have no objection, subject to the above concerns. Staff
would note that the concerns as noted would be addressed at
such time that an access permit is applied for.
In view of the above comments, the By-law is attached for
Council 's approval .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84- 95
being a By-law to amend By-law 2111, as amended, of the former
Township of Darlington, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law 2111, as amended, of the
former Township of Darlington.
NOW, THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1 . Map 26 of Schedule "A" to By-law 2111 , as amended, is hereby
further amended by changing to "SPECIAL PROVISION BY-LAW 84-95 " the
zone designation of lands indicated as "ZONE CHANGE TO SPECIAL
PROVISION BY-LAW 84- 95" on the attached Schedule "X" hereto.
2. Section 13 of By-law 2111, as amended, is hereby further
amended by adding thereto subsection (ggg) as follows:
"(ggg) Part of Lot 22, Broken Front Concession
Notwithstanding any provisions of this By-law to the contrary,
that portion of Lot 22, designated "SPECIAL PROVISION BY-LAW
84-95 " on the attached Schedule "X" hereto, shall be used only
in accordance with the following provisions:
(1) Permitted Uses
a) a pigeon racing clubhouse facility, and buildings and
structures accessory thereto.
(2) Zone Provisions
(a) Lot Area (minimum) .45 hectares
(b) Lot Frontage (minimum) 50.0 metres
(c Front Yard (minimum) 15.0 metres
(d; Exterior Side Yard (minimum) 15.0 metres
(e) Interior Side Yard (minimum) 20.0 metres
�f Rear Yard (minimum) 130.0 metres
9 Building Height (maximum) 10.0 metres
3. This By-law shall come into effect on the final passage
hereof.

BY-LAW read a second time this 23rd day of July 1984
BY-LAW read a third time and finally passed this 23rd day of
July 1984.
