That Report PD-135-84 be received; and * 2. That the attached by-law authorizing execution of a Subdivision Agreement between Toronto- Dominion Bank and the Corporation of the Town of Newcastle, be approved; and 3. That the Mayor and Clerk be authorized to execute a Subdivision Agreement between Toronto-Dominion Bank and the Town of Newcastle i at such time as an Agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. . ..2 i (C) REPORT NO. : PD-135-84 Page 2 BACKGROUND AND COMMENTS: A Rezoning Application was considered and approved by Council on May 28, 1984 in respect of draft Plan of Subdivision 18T-81015 located in Part of Lot 34, Concession 2, former Township of Darlington, part of the Courtice Urban Area. The subject plan of subdivision has been draft plan approved, and the lands, as noted above, are presently in the process of being rezoned - final date for objection July 2, 1984. D. G. Biddle and Associates have expressed an interest on behalf of the Toronto-Dominion Bank in proceeding with building on the subject lands at the earliest possible opportunity. Aside from the rezoning, the only outstanding issue is the finalization of a Subdivision Agreement, which is also currently under preparation. In that regard, in order to expedite registration of this plan, Staff feel that it would be appropriate at this time to authorize execution of a Subdivision Agreement with the Toronto-Dominion Bank, and that said agreement be executed at such time as the agreement has been finalized to the satisfaction of the Director of Planning and the Director of Public Works. July 4, 1984 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84- 96 being a By-law to authorize the entering into of an Agreement with Toronto-Dominion Bank and the Corporation of the Town of Newcastle. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1 . THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal , an Agreement between Toronto-Dominion Bank and the said Corporation dated the day of 1984, in the form attached hereto as Schedule 'T'. 2. THAT Schedule 'T' attached hereto forms part of this by-law.
