ULLRICH PART LOT 11 , CONCESSION 5, DARLINGTON OUR FILE: DEU 84-17 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-148-84 be received; and * 2. That the attached zoning by-law amendment , amending By-law 84-63 in respect of Part of Lot 11 , Concession 5, former Township of Darlington to permit the construction of an abattoir to be used in conjunction with the existing meat processing plant , be approved. I i i .. .2 REPORT NO. : PO-148-84 Page 2 BACKGROUND: On May 14, 1984, the Planning Department received an application submitted by Mr. Ullrich to rezone a parcel of land located on Part of Lot 11 , Concession 5, former Township of Darlington. The purpose of the rezoning would be to permit the construction of an abattoir to be used in conjunction with the existing meat processing plant. Staff would note for Committee' s information that a previous application was submitted regarding Part of Lot 11 , Concession 5, former Township of Darlington, whereby the applicant requested an amendment to the Zoning By-law to permit a meat cutting and processing plant on the site. Accordingly, By-law Amendment 75-80 was approved on January 14, 1976 rezoning the subject property as "C1 -1 Commercial " to be used for the purpose of a custom meat cutting and smoking operation. In accordance with departmental procedures , the application was circulated to various Town departments and outside agencies for their review and comments. Town of Newcastle Fire Department "Emergency fire response would be from Station #1 with water supplied by Fire Department tanker trucks." Ministry of Agriculture and Food "The construction of the slaughter house would be a worthwhile addition to Mr. Ullrich's present meat processing business. There should be little, if any, obnoxious odour problem, as the building will be situated on an existing _ farm and a long distance from nearby residents." . . .3 REPORT NO. : PD-148-84 Page 3 Regional Health Unit " Insofar as health matters are concerned there are no objections to the application. NOTE: Disposal of sewage and blood will be undertaken at the building permit stage. The required permit will be issued only after a proper inspection of the land area involved has been made and said inspection will be carried out upon receipt of a formal application." Durham Regional Planning Department "There are no concerns with respect to the impact of the proposal on the abutting Regional Road No. 14. Furthermore, the subject site is designated "Permanent Agricultural Reserve" in the Durham Regional Official Plan. The proposed abattoir is considered to be a farm-related use. Proposal conforms." WHEREAS the Council of the Corporation of the Town of Newcastle enacts as follows: 1 . Schedule "1" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "A-18" to "ZONE CHANGE TO A-18" as indicated on the attached Schedule "X" hereto. 2. Section 6.4.18 of By-law 84-63, as amended, is hereby further amended by adding thereto the words "and an abattoir" after the words "meat cutting and meat smoking operation". 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
