That Report PD-153-84 and the minutes of the Committee of Adjustment meeting of August 8, 1984 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and Administration Committee, staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of August 8, 1984. This list includes the file number, applicant's name, site location , type of variance requested, staff's comments on the applications, and the Committee of Adjustment' s decision. Respe bmitt , i. Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the use of a lot with an existing single family dwelling having a front yard of 14.33 ft. (4.3 m) , instead of the required 6 m front yard and a rear yard of 20 ft. (6 m) , instead of the required 10.5 m (35 ft. ) rear yard. Mr. MacGregor and Mr. Barber appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Muir, "THAT as the requested variance does not appear to offend the intent of the Official Plan or Zoning By-law and would permit the continued use of an existing non- conforming dwelling, the application is considered minor in nature and permission is GRANTED to continue the use of a lot with an existing single family dwelling having a front yard of 14.33 feet (4.3 m) and a rear yard of 20 feet (6m) . Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an open porch to the existing single family dwelling, leaving a front yard of .5 feet ( . 15 m) and a non-conforming set back and maintaining an existing legal non-conforming 3.6 ft. (1 .09 m) side yard, instead of the required 20 ft. ( 6 m) front yard and 53 ft. (16.2 m) set back. Mr. Thorne appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Reicheld, seconded by Mrs. Payne, "THAT as the proposed variance appears to comply with the intent of the Official Plan and Zoning By-law and as the proposed proch will be open and cover an existing cement slab, the variance would not appear to have a detrimental effect on the surrounding neighbourhood and therefore permission is GRANTED to ocnstruct a porch leaving a front yard of .5 feet ( .15m) and a set back of 8. 1 m and maintaining the existing legal non-conforming yards to the existing single family dwelling." Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a deck at the rear of the existing single family dwelling, maintaining the existing non- conforming front yard, side yard and set back. No person appeared in support of or in opposition to this application. Moved by Mr. Muir, seconded by Mr. Reicheld, "THAT as the proposed deck does not offend the intent of the Official Plan or Zoning By-law and as the deck is located at the rear of the dwelling and not further encroaching the non-conforming yards the variance is considered minor in nature and would not have an adverse effect on the surrounding area, therefore the application is GRANTED to construct a deck miantaining the existing non-conforming front yard, side yard and set back. Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the construction of a storage shed, leaving a 1 ft. rear yard, instead of the required 25 ft. rear yard and maintaining a 2 ft. side yard to the existing attached storage shed, instead of the required 25 ft, side yard. J. Silva appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Reicheld, "THAT as the proposed variance does not appear to offend the intent of the Official Plan and would allow the expansion of an existing industry, permission is GRANTED to continue the construction of a storage shed and continue the use of an existing shed leaving a 1 ft. rear yard and a 2 ft. easterly side yard, on condition that: 1 . The applicant enter into a Site Plan Agreement with the Town to address such things as, but not limited to: emergency access and site drainage. 2. The exterior cladding of both the existing and proposed structures to be of similar treatment (all block / or all metal cladding. 3. Submission of an engineer' s report certifying that the existing and proposed structures comply with the Ontario Building Code; failing compliance, the non-conformity is to be brought into compliance. 4. Building permits are to be obtained. 5. The proposed and existing storage shed to be removed at such time as a new principle building is constructed. Moved by Mr. Muir, seconded by Mrs. Payne, "THAT as the requested variance does not appear to offend the intent of the Official Plan or Zoning By-law and does not appear to have a detrimental effect on the surrounding area, the application is considered minor in nature and permission is GRANTED to use this lot for residential purposes with a frontage of 76 feet, instead of the required 80 ft. frontage." Moved by Mrs. Payne, seconded by Mr. Muir, "THAT as the requested variance would allow the expansion of an existing institutional building and would not be detrimental to the surrounding area or offend the intent of the Official Plan or Zoning By-law and as the addition will not be en- croaching further into the exterior yard than the existing building, the application is considered minor in nature and permission is GRANTED to construct the addition leaving an exterior side yard of 19 ft.
