SUBJECT: APPLICATION TO AMEND DURHAM REGIONAL OFFICIAL
PLAN - LUVERME INVESTMENTS LIMITED
PART LOT 14, CONCESSION 2
FORMER TOWN OF BOWMANVILLE

RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-164-84 be received; and
2. That the Region of Durham be advised that the
Town of Newcastle has no objection to the
application submitted by Luverme Investments
Limited to amend the Durham Regional Official
Plan to permit the creation of nineteen (19)
Estate Residential lots in Part of Lot 14,
Concession 2, former Town of Bowmanville; and
3. That a copy of Council 's decision be forwarded
to the Region of Durham and the applicant.

BACKGROUND:
On July 24, 1984, the Town of Newcastle was advised by the
Region of Durham Planning Department that it had received an
application submitted by Luverme Investments Limited to
amend the Durham Regional Official Plan to permit the
creation of nineteen (19) Estate Residential lots on a 16
hectare (40 acre) parcel located in Part of Lot 14,
Concession 2, former Town of Bowmanville. The creation of
fourteen (14) Estate Residential lots on the subject
property was permitted by Amendment #5 to the Durham
Regional Official Plan which was approved by the Ministry of
Municipal Affairs and Housing on March 21 , 1979. A proposed
Plan of Subdivision for the subject property was draft
approved by the Ministry of Municipal Affairs and Housing on
March 22, 1979. The property was subject to Special
Condition #11 in By-law 1587, as amended, of the former Town
of Bowmanville, which recognized and implemented the draft
approved plan of subdivision; the subject property is zoned
"RE-Estate Residential" in By-law 84-63, the Comprehensive
Zoning By-law.
In accordance with departmental procedure, the application
was circulated to various departments and agencies for
comment. As well , the Region of Durham provided copies of
comments received through their circulation of the
application. As a result of the circulation, no major
concerns were identified. As well , no submissions were
received from the public with respect to this application.
COMMENT:
The property subject to the application lies within the
Major Open Space system with a portion of the site being

designated "Environmentally Sensitive and Hazard Land" . As
indicated earlier, the principle of Estate Residential
development on the property was established through
Amendment #5 to the Durham Regional Official Plan. As well ,
the Plan of Subdivision for the property has been draft
approved and zoning provisions for the property recognized
in both the former and existing zoning by-laws. Further,
the anticipated population that would result from the
increased number of lots would conform with the density
requirements for Estate Residential development as
established by the Durham Regional Official Plan.
Staff note that the revised plan submitted with the
application differs substantially from that which was draft
approved and therefore, an application for redline revisions
is required. Town Staff and Council will have the
opportunity to comment on any application for redline
revision. Staff further note that the lots as proposed by
the Official Plan Amendment application would not conform
with the minimum frontage and area requirements of the
Estate Residential zone in By-law 84-63. A rezoning
application has been submitted by the applicant and Staff
will be bringing forward a recommendation on that
application at such time as Regional Council has made a
decision with respect to the Official Plan Amendment
application.

Inasmuch as the principle of Estate Residential development
has already been established on the property, the
application conforms with the density requirements of the
Durham Regional Official Plan, and no major concerns were
identified through the circulation of the application , it is

Town of Newcastle has no objection to the approval of the
Official Plan Amendment application.
