That Report PD-165-84 and the minutes of the Committee of Adjustment meeting of September 5, 1984 be received for information. Murdoch Member Arnold Reicheld Current Operations Planner Larry Taylor Secretary Carrol Dlemens APPLICAITONS: A 76/84 - Robert Brown, Lot 11 , B. F. Concession, Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to continue the use of a single family dwelling having a side yard of 2.73 feet, instead of the required 4 ft. side yard and an existing industrial building having a side yard of 10.5 feet, instead of the required 25 ft. side yard. Robert Brown and Earl Bailey appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Muir, "THAT as the requested variance would not appear to offend the intent of the zoning By-law or Official Plan and would not appear to have a detrimental effect on the surrounding neighbourhood, permission is GRANTED to continue the use of a single family dwelling having a side yard of 2.73 ft. ( .8 m) and an existing industrial building having a side yard of 10.5 feet (3.2 m)" "CARRIED" A 77/84 - Ronald and Linda Farrow, Lot 9, Concession 4, Clarke. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition at the rear of the existing single family dwelling maintaining an existing 39 ft. front yard, instead of the required 50 ft. front yard and an existing non-conforming set back. "CARRIED" A 78/84 - Wilsmap Limited, Lot 11 , Concession 1 , Bowmanville. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to the existing commercial building, maintianing the existing non- conforming yards and to construct a commercial building, leaving a 0 side yard, instead of the required 4 ft. ( 1 m) side yard. Rick Gay and Dr. Rudell appeared in support of this application. Irwin Hamilton representing Mr. MacDonald appeared in opposition to this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Reicheld, seconded by Mr. Murdoch, "THAT as the requested variance does not appear to offend the intent of the Official Plans or Zoning By- law, permission is GRANTED to construct a commercial building leaving a 0 side yard and to construct an addition to the existing commercial building maintaining the existing non-conforming yards. This approval is subject to approval of a Site Plan Agreement with the Town of Newcastle Planning Department. "CARRIED" 'Muir & Payne opposed' Committee of Adjustment Meeting, September 5, 1984. . . . . A 79/84 - Terry and Dorene Kelsey, Lot 17, Concession 1 , Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct an addition to the existing single family dwelling, leaving a 2 m (7 ft.) side yard, instead of the required 20 ft. side yard. Mr. Kelsey appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Murdoch, seconded by Mr. Muir, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By- law and would not appear to have a detrimental effect on the surrounding area, permission is GRANTED to construct an addition to the existing single family dwelling leaving a 2 m (7 ft. ) side yard and main- taining the existing non-conforming set back. " "CARRIED" A 80/84 - Blayne and Carolyn Flint, Lot 20, Concession 2, Darlington. Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a single family dwelling leaving side yards of 12 ft. (3.6 m) , instead of the required 20 ft. (6 m) side yards. Mr. Flint appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Muir, seconded by Mrs. Payne, "THAT as the requested variance would not appear to offend the intent of the Official Plan or Zoning By-law or have a detrimental effect on the surrounding area, permission is GRANTED to construct a single family dwelling having 12 ft.
