That Report PD-171-84 be received; and 2. That By-law 83-83, being a by-law to constitute a Committee of Adjustment for the Town of Newcastle, be amended in accordance with the proposed by-law amendment included as * Attachment No. 1 hereto. I I l�f� 4 tug REPORT NO. : PD-171-84 Page 2 BACKGROUND AND COMMENTS: As the members of Council are aware, a vacancy exists on the Committee of Adjustment and pursuant to By-law 83-83, where a vacancy occurs , the Council shall appoint another eligible person for the unexpired portion of the term of Council . By-law 83-83 also establishes the number of persons comprising the Committee. Staff have discussed the matter of the vacancy with the Committee Chairman , Mr. Tom Rheder, as well as the other members of the Committee of Adjustment and have determined that there have been no problems encountered by the Committee as a result of the vacancy. Staff note that a Committee of five (5) persons is, in some respects , more advantageous in that it avoids split decisions when all members of the Committee are present. The only concern noted by Committee members was that originally the composition of the Committee was designed to provide representation from all Wards based upon the fact that there were different zoning by-laws for each Ward. With the approval of By-law 84-63, the Town now has one Zoning By-law and, in Staff's opinion, the need for equal representation from each Ward is not as essential . Staff would also note that the minimum number of members for a Committee is three (3), and there is no statutory requirement to have a Committee of more than three (3) persons. In that regard, Staff respectfully recommend that i the present vacancy not be filled for the balance of Council 's term, and that By-law 83-83 be amended in accordance with Attachment No. 1 hereto. Staff note that i . ..3 i REPORT NO. : PD-171-84 Page 3 approval of the proposed by-law amendment would not preclude the filling of the vacancy, but would allow greater flexibility in establishing the number of members for that Committee. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 83-83; NOW THEREFORE the Council of the Corporation of the Town of Newcastle, pursuant to Section 43 of the Planning Act, 1983, enacts as follows: 1 . Section 1 of By-law 83-83, is hereby deleted in its entirety and replaced with the following new Section l : "l. That a Committee of Adjustment within the meaning of the Planning Act, 1983 composed of, no fewer than, three (3) persons and no more than six (6) persons, is hereby constituted for the Town of Newcastle." 2. Section 4, By-law 83-83, is hereby deleted in its entirety and replaced with the following new Section 4: "4. Where a member of a Committee ceases to be a member before the expiration of his or her term, the Council of the Town of Newcastle shall appoint another eligible person for the unexpired portion of the term where such a vacancy results in the loss of a quorum. In all other cases Council may, at their discretion, appoint another eligible person for the unexpired portion of the term."
