RECOMMENDATION:
It is respectfully recommended to Council :

1 . That Report PD-175-84 be received; and 1
2. That the proposed amendment to By-law 76-25, as f
* amended, as shown on Attachment No. 2 hereto,
be approved; and
3. That Council approve one of the three
* alternatives included as Attachments No. 3
through 5 inclusive and the necessary By-law be
approved.

BACKGROUND AND COMMENTS:
On October 1 , 1984, the General Purpose and Administration
Committee considered Staff Report PD-168-84 in respect of
the Town of Newcastle Sign By-law. At that time the
Committee authorized Staff to proceed with the necessary
notices and requested that Staff consider preparation of a
revision to the originally proposed amendment which would
extend the coverage of the Ministry of Transportation and
Communications regulations beyond the four hundred (400)
metre limit.
Staff can advise that on October 3, 1984 public notice was
published in the local papers thus fulfilling the require-
ments of the Municipal Act. We would also advise that the
necessary review was undertaken and a revised by-law
* amendment prepared, which is included as Attachment No. 4
hereto, and identified as Alternative No. 2. Attachment No.
3 is a copy of the by-law originally proposed at the meeting
of October 1 , 1984 and Attachment No. 5 is a further
proposal which provides for incremental increases in sign
size related to the distance from a Provincial highway.
Attachment No. 1 includes a comparative summary of the three
(3) alternatives specifying the various sign heights, width,
and areas. Alternative No. 1 would provide the relief in
the Sign By-law requested by the applicant originally.
Alternative No. 2 would simply extend the Ministry of
Transportation and Communications size restrictions to a
point some six hundred (600) metres from a Provincial
highway, and Alternative No. 3 would allow for slight
increases in sign areas as the location becomes further
removed from a Provincial Highway.

Staff are recommending that the amendment to Sign 8y-law
* included as Attachment No. 2 be approved and that the
Committee approve one of the three alternatives
included as Attachments No. 3 through 5 inclusive.

being a By-law to amend By-law 76-25, of the Corporation of the
Town of the Town of Newcastle, being the Town of Newcastle
Comprehensive Sign By-law.
WHEREAS, an application has been received for an amendment to By-law
76-25 of the Town of Newcastle;
AND WHEREAS, the Municipal Act provides that Council of a municipal
Corporation may pass by-laws for prohibiting or regulating signs, or
other advertising devices;
AND WHEREAS, the Council of the Town of Newcastle deems it
appropriate to amend By-law 76-25;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1 . Section 1 of By-law 76-25, Subsection 2(a) - Lands Subject to
By-law, is hereby amended by adding thereto the following words:
"Notwithstanding the foregoing, where lands within the corporate
limits of the Town of Newcastle abut a Provincial Highway which
does not form a portion of a connecting link, as defined by the
Ministry of Transportation and Communications, and such lands
are not located within a residential area, a main central area
or a community central area as designated by an Official Plan in
effect for the Town of Newcastle, and where such lands are
subject to sign regulations established by the Ministry of
Transportation and Communications, the provisions of this by-law
shall not apply provided that a valid Sign Permit has been
issued by the Ministry of Transporation and Communications in
respect of any sign located or proposed to be located on such
lands, and further, provided that evidence of such permit is
provided to the Chief Building Official of the Corporation of
the Town of Newcastle."
2. This By-law shall come into effect on the date of passing
hereof.

BY-LAW NUMBER 84-
being a By-law to amend By-law 76-25, of the Corporation of the
Town of the Town of Newcastle, being the Town of Newcastle
Comprehensive Sign By-law.
WHEREAS, an application has been received for an amendment to By-law
76-25 of the Town of Newcastle;
AND WHEREAS, the Municipal Act provides that Council of a municipal
Corporation may pass by-laws for prohibiting or regulating signs, or
other advertising devices;

making all necessary adjustments to the Subsection numbers affected

advertises goods, products, or services which may or may not be
sold on the premises on which the sign is located."
2. Section 4 of By-law 76-25, Subsection 5 - "Prohibition of
Certain Signs", is hereby amended by adding thereto the following
words:
"Billboard Signs shall only be permitted within 600 metres of
Provincial Highways, 35/115 and the 401".
3. Section 4 of By-law 76-25, is further amended by adding
thereto the following new Subsection 15 as follows:
"l 5. BILLBOARD SIGNS
i
Where a billboard sign is permitted to be erected, the
following sign provisions shall apply.
i) Billboard signs shall not be located in, or closer than
150 metres to any residential zone or use.
ii) Sign Height (maximum)
a) Signs located within 400 metres of a Provincial
Highway - Subject to Ministry of Transportation and
Communications regulations.
b) Signs located more than 400 metres, but less than
450 metres - 13.5 metres.

c) Signs more than 450 metres, up to 600 metres -
15.0 metres,

iii) Sign Width (maximum)
a) Signs located within 400 metres of a Provincial
Highway - Subject to Ministry of Transportation and
Communications regulations.
b) Signs located more than 400 metres, but less than
450 metres - 14 metres.
c) Signs more than 450 metres, up to 600 metres - 25.0
metres.
iv) Billboard signs shall not be located closer than 2000
metres from any other billboard sign regardless of
which side of the Provincial Highway the other sign is
located on, excepting:
a) that a maximum of two (2) billboard signs facing
the same direction may be placed at one (1)
location provided the combined width of the two (2)
signs does not exceed the foregoing provisions set
out in (iii) above; and
b) a maximum of two (2) billboard signs may be placed
back to back, to the signs as set out in a) above
provided that the combined width of these two (2)
additional signs is equal to the combined width of
the signs described in a) above, and that the width
does not exceed the specific provisions set out in
(iii) above; and
c) the above separation distance would not apply to
billboard signs on opposite sides of grade
separated railway crossings.
v) All measurements referred to herein, shall be taken
from the extreme outside point of the sign structure."
r 4. This by-law shall come into effect on the date of passing

v) Billboard signs shall not be located closer than 1000
metres from any other billboard sign regardless of
which side of the Provincial Highway the other sign is
located on, excepting:
a) that a maximum of two (2) billboard signs facing

the same direction may be placed at one (1)
