That Report PD-183-84 and the minutes of the Committee of Adjustment meeting of October 17, 1984 be received for information. BACKGROUND AND COMMENT: For the information of the General Purpose and * Administration Committee, staff have prepared the attached list of applications to the Committee of Adjustment for the meeting of October 17, 1984. This list includes the file number, applicant' s name, site location, type of variance requested, Official Plan conformity, By-law conformity, staff's comments on the applications, and the Committee of Adjustment's decision. Auger Szwarz Secretary Carrol Clemens APPLICATIONS: A 82/84 - Kenneth and Florence Jackson, Lot 28, Conc. 5, Clarke— Application was made for relief from zoning by-law requirements in order to permit the applicant to construct a second storey addition over a portion of the existing dwelling within 100 feet of a stream or river bank and maintaining the existing front yard, side yards and set back, whereas, the by=law requires a side yard of 14 feet on one side and 6 feet on the other side, 20 ft. front yard, 16.2 m (53 ft. ) set back and no building to be located within 100 feet of a stream or river bank. The property has no off-street parking. Mr and Mrs. Jackson appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Rehder, seconded by Mr. Muir, "THAT as the By-law requires on-site parking to be provided when an addition is made to an existing building which increases the floor area, and as the subject property does not appear to be able to provide the required parking, this variance would not be in keeping with the intent of the Zoning By- law and cannot be considered minor in nature and there- fore the application is DENIED. Application was made for relief from zoning by-law requirements in order to permit the applicant to create a lot with an existing garage having a side yard of .54 m (1 .8 feet) , instead of the re- quired 1 .25 m side yard and maintaining an existing .3 m ( 1 ft. ) front yard. G. White appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mr. Muir, seconded by Mr. Murdoch, "THAT as the proposed variance would not offend the intent of the Official Plan or Zoning By-law and as the garage has been in existance in this location for many years, permission is GRANTED to create a lot with an existing garage having a side yard of .54 m and maintaining a .3 m front yard. " "CARRIED" A 84/84 - Edvan Realty Ltd. , Lot 28, Concession 1 , Clarke. Application was made for relief from zoning by-law requirements in order to permit the applicant o create a lot with a frontage of 10.06 m and an area of 40122 m , instead of the required 15 m frontage and area of 460 m , with an existing residential building having a side yard of 2. 176 m. Ed Vanhaverbeke appeared in support of this application. No other person appeared in support of or in opposition to this application. Moved by Mrs. Payne, seconded by Mr. Reicheld, "THAT as the proposed variance would not offend the intent of the Official Plan or Zoning By-law, and as the variance would not have a detrimental effect on the surrounding area and would not be creating an additional building lot, permission is GRANTED to create a lQt with a frontage of 10.06 m and an area of 401 .2 m with an existing residential building having a side yard of 2. 176 m. " "CARRIED" Appeal date for the foregoing applications is November 16, 1984. Next meeting of the Committee of Adjustment is November 14, 1984. Inspection meeting for the next meeting is November 10th. at 9:30 a.m. Meeting adjourned at 10:00 p.m.
