OF DARLINGTON FILE: DEU 84-30 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-192-84 be received; and 2. That application for rezoning in respect of Part of Lot 14, Concession 2, former Township of Darlington be approved, and that the * attached By-law to amend By-law 84-63 be forwarded to Council for approval . . ..2 e- REPORT NO. : PD-192-84 Page 2 BACKGROUND AND COMMENTS: At the meeting held on October 9, 1984, Council endorsed the following resolution : "The Region of Durham be advised that the Town of Newcastle has no objection to the application submitted by Luverme Investments Limited to amend the Durham Regional Official Plan to permit the creation of nineteen (19) Estate Residential lots in Part of Lot 14, Concession 2, former Town of Bowmanville; and A copy of Council 's decision be forwarded to the Region of Durham and the applicant." Regional Staff advises, that the proposed Amendment #120 to the Regional Official Plan had been approved by Regional Council on November 7, 1984. As noted within Staff Report PD-164-84 re: the Official Plan Amendment, a rezoning application has been submitted by D.G. Biddle and Associates Limited, on behalf of the applicant, for review. In accordance with departmental procedures, the application was circulated to various departments and agencies for comment. The following would summarize the responses as received : Ministry of Natural Resources "Thank you for the opportunity to review these proposals. As mentioned in our letter dated May 13, 1977, with regard to the plan of subdivision 18T-76071 , we have a concern for the coldwater fish habitat in Bowmanville Creek. In order to protect this fishery concern, we recommend Block 20 be place in a zoning provision which would have the effect of prohibiting all buildings and structures, except those necessary for flood or erosion control ." . . .3 REPORT NO. : PD-192-84 Page 3 Ministry of the Environment "No objections." Central Lake Ontario Conservation Authority "The Authority Staff have no objections to the approval of the above application for rezoning." Ministry of Agriculture & Food - Foodland Preservation "Staff of the Ontario Ministry of Agriculture and Food have reviewed the above development proposal . Consideration has been given to the proposal in terms of the goals and objectives of the Ministry and of the criteria and policies outlined in the Food Land Guidelines. Based on our present knowledge, the Ministry has no objections to the proposal ." Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board "In reply to your letter of July 23, 1984, please be advised that this Board has no objections to the amendment." Region of Durham Health Unit "The above application for rezoning has been investigated by this Health Unit, and insofar as health matters are concerned, there are no objections to its approval . I would, however, stress that this letter is not to be taken as a permit to install a private sewage disposal system at the site involved. The required permit will be issued only after a propoer inspection of the land area involved has been made and said inspection will be carried out upon receipt of a formal application." Region of Durham Planning Department "Further to your request for comments, we note that the proposed estate residential development is also the subject of an official plan amendment application (Our File: 84-23/D). Accordingly, we will be liaising with you during the official plan amendment process." .. .4 REPORT NO. : PD-192-84 Page 4 Town of Newcastle Fire Department "This Department has no objection to the application as above-headed. This is within an acceptable emergency travel distance from Fire Station #1 with water supplied by Fire Department tanker trucks for firefighting. I would suggest that consideration be given to Fire Protection Requirements for Rural Development , re: P.D. Report 40-84." Town of Newcastle Public Works Department "As requested, we have reviewed the above-noted application for rezoning and have no objection to this proposal subject to the following comments : - That the owner enter into a Development Agreement with the Town, and that this department be kept informed of the status of same at all times ; - That all works are completed in accordance with the Town of Newcastle' s Design Criteria and Standard Drawings; - That any easements required by the Town be granted free and clear of any encumberances; - All of the other standard requirements re: Lot Grading, Schedules of Work, Performanace Guarantees, Cost Estimates, etc., should be included in the Subdivision Agreement ; - The Owner is required to provide street illumination to Town standards on all roadways including Concession Street; - That the owner reconstructs Concession Street to Town Standard (NS-2.01 ) from Munday Court to Regional Road 57. - That the owner meet all the requirements of the Public Works Department, financial or otherwise." STAFF COMMENTS: In consideration of the comments received, Staff would offer the following for Committee's information. 0005 REPORT NO. : PD-192-84 Page 5 Within Zoning By-law 84-63, Block 2.0, with the exception of that portion abutting the easterly side of the southern cul-de-sac (Munday Court) , is zoned "EP-Environmental Protection". This is representative of the draft Plan of Subdivision (18T-76071 ) as previously draft approved. A minor revision/alteration to the "EP" designation within Zoning By-law 84-63, as a result of the submission of the revised plan of subdivision considered by Committee (for both the Official Plan Amendment and Rezoning Application) , is necessary to comply with the Ministry of the Environment' s comments pertaining to Block 20. The Central Lake Ontario Conservation Authority made no reference to the need for the rezoning of Block 20, within their comments. As noted above, with the exception of the small portion abutting the southerly cul-de-sac , Block 20 is presently zoned "EP" within By-law 84-63. Accordingly, the Conservation Staff indicated they had no objections to the rezoning as submitted. Staff would note that the comments submitted by the Town's Fire Department and Public Works Department, while favourable to the rezoning as requested, do however list various concerns, which Staff note, would be dealt with through the Subdivision approval and agreement process at such time as a red-line revision to Draft Plan 18T-76071 is submitted for review. The necessary Official Plan Amendment was approved by Regional Council on November 7, 1984. Accordingly, in consideration of the above-noted comments and concerns, Staff would have no objection to the approval of the rezoning application as submitted, and forwarding of the attached zoning by-law amendment to Council for approval . . ..6 Ut � r-� REPORT NO. : PD-192-84 Page 6 Respectfully submitted, T.T. Biddle & Associates 96 King Street East OSHAWA, Ontario UH 1B6 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84- being a By-law to amend By-law 84-63, of the Corporation of the Town of Newcastle, being a Comprehensive Zoning By-law. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63 of the Corporation of the Town of Newcastle; NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as follows: 1. Section 8.3 is hereby amended by adding thereto the following new Subsection 8.3.5 as follows: "8.3.5 RESIDENTIAL ESTATE EXCEPTION (RE-5) ZONE Notwithstanding Section 8.2, those lands zoned RE-5 on the Schedules to this By-law shall be subject to the following regulations: i) Lot Area (minimum) 4000 square metres ii) Lot Frontage (minimum) 30 metres" 2. Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "RE-Residential Estate Zone" to "RE-5 Residential Estate Exception (RE-5) Zone" and "EP-Environmental Protection Zone" as shown on the attached Schedule "X" hereto. 3. Schedule "X" attached hereto shall form part of this by-law. 4. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act, 1983.
