That Report PD-197-84 be received; and 2. That Council adopt the following resolution: "The Council of the Town of Newcastle hereby requests the Minister of Municipal Affairs and Housing to extend the draft plan ' approval for Subded�speriodTto90anua� further one (1 ) y y 29, 1986"; and 3. That the request in Recommendation No. 2 above be forwarded to the Minister of Municipal Affairs and Housing and that Remlark Holdings Limited be so advised. ...2 i i REPORT NO. : PD-197-84 Page 2 BACKGROUND AND COMMENTS: * A copy of the attached letter was received by the Planning and Development Department on November 8, 1984. The letter addressed to Mr. Mark Foley of Remlark Holdings Limited , from the Ministry of Municipal Affairs and Housing, states that the draft plan approval of the above-mentioned plan will lapse on January 2.9, 1985. Mr. Foley, in responding to the Ministry' s letter of notice , indicated that "we have experienced very difficult economic times and up until recently, have been unable to finance the completion of the engineering and surveying drawings to permit the registration of the above subject subdivision. We are more confident that we can now complete this project and would sincerely appreciate your indulgence in permitting an extension to the draft approval for twelve (12) months, to January 29, 1986". As you may know, it is your responsibility to request an extension, with reasons , well in advance of the lapsing date. Please Note: We have recently changed our procedures -f'-or extensions to draft approval for plans of subdivisions in the Regional Municipality of Durham. In the past, we required you to secure a council resolution in support of an extension before we would grant it. This procedure involved considerable amounts of time for owners , staff and council, with few concerns being raised. We have therefore tried to simplify the procedure. Your request for extension t with reasons , is now to be submitted directly to this office etore the lapsing date, with copies to the municipality and regional planning depar.tment for information. The local municipality has been supplied with a list of draft approved plans and their lapsing dates in order to undertake an ongoing review. If , for some reason, council feels and extension is unadvisable, we have asked them to inform us directly before the lapsing date. If we do not hear from them, we assume no objection and will process the extension request. Please remember, that once draft approval has lapsed, it cannot be reinstated. A new application would have to be submitted to the Regional Municipality of Durham.
