OF DARLINGTON PARTS 12,13,14 & 15, PLAN 1OR-1389 FILE: DEV 84-36 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-199-84 be received; and 2. That application for rezoning in respect of Part of Lot 32, Concession 2, former Township of Darlington , be approved; and * 3. That the attached By-law to amend By-law 84-63 be forwarded to Council for approval . .. .2 (?J (1V REPORT NO. : PD-199-84 Page 2 BACKGROUND: On October 26, 1984, the Planning Department received an application submitted by D.G. Biddle and Associates on behalf of Veltri and Son Limited to rezone a parcel of land located in Part of Lot 32, Concession 2, former Township of Darlington. The submission of the rezoning application was in acknowledgement of discussions that the applicant has had with the Central Lake Ontario Conservation Authority staff respecting the subject property and the providing of a building envelope on the southerly portions of Parts 12 and 15 on Plan IOR-1389 for residential purposes. SUMMARY OF CIRCULATION COMMENTS: In accordance with departmental procedures, the subject application was circulated to concerned agencies and departments within the Town to obtain their comments. The following departments have responded, indicating no objections to the proposed rezoning: i ) Region of Durham Planning Department ii ) Town of Newcastle Works Department iii ) Central Lake Ontario Conservation Authority iv) Town of Newcastle Building Department V) Town of Newcastle Fire Department vi ) Ministry of Natural Resources Staff would note for Committee' s information that the appropriate public notice signs were placed upon the site in accordance with Council Policy and pursuant to the requirements re: Public Notice of a Public Meeting, within the Planning Act. . ..3 i i i REPORT NO. : PD-199-84 Page 3 STAFF COMMENTS: In consideration of the application as submitted; the comments as received, Staff would have no objection to the rezoning, noting that the By-law amendment would confirm that only one (1 ) single family dwelling may be permitted on the subject lands, outside of the area of concern as noted through the submission of the application. Staff would note that, within By-law 84-63, the subject property is presently zoned "R1 -4 - Urban Residential Exception (RI -4) Zone" which would permit a single family dwelling unit. The By-law amendment as proposed specifically identifies the limits of an Environmental Protection zone on the subject lands. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63 of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as follows: 1. Schedule 3 of By-law 84-63 is hereby amended as follows: "a) by deleting the "Rl-4" zone designation on the lands shown on Schedule "X" hereto and replacing same with a "EP" zone designation." 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act, 1983.
