RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 . That Report PD-203-84 be received; and
2. That Staff take no further action relative to
decision of LD 195/84.

BACKGROUND AND COMMENTS:
Application LD 195/84 was received by Staff for review on
June 1 , 1984. The purpose of the application as noted on
the application form was "for a retirement lot" . The
comments prepared by Staff, to the Land Division Committee
with respect to conformity to Official Plan policies and the
Zoning By-law, were as follows :
CONFORMITY WITH OFFICIAL PLAN
"The subject lands are designated "Major Open Space" by
the Region of Durham Official Plan. Section 12.2.4 of the
Regional Plan would allow the severance of a retirement lot
for a bona-fide farmer provided that the subject property
has been in the retiring farmer's ownership for not less
than ten (10) years. In that regard, if the Committee is
convinced that the applicant is indeed a bona-fide farmer ,
then the requested severance would be in conformity with the
policies of the Official Plan."
Further it was noted that the subject and retained lands
complied with the applicable provisions of the zoning
by-law. Staff accordingly recommended approval on the
condition that a lot development charge be paid to the Town
of Newcastle.
At the Land Division Committee meeting held on June 25,
1984, Mr. Knapp advised the Committee that he did not farm,
but rented the pasture and grain planting to neighbouring
farmers. Mr. Knapp had advised the Committee previously
that he had owned the farm since 1957. The one hundred and
eleven (111 ) acres was what was left of an approximate one
thousand (1 ,000) acre farm which had been in the family
since Indian trading times.

A motion of the Committee was made to the effect that
application LD 195/84 be approved as applied for, as such is
a retirement lot for a bona-fide farmers. The motion which
incorporated various conditions, in respect of such a
severance, was lost. A further motion was moved that
application LD 195/84 be denied as it did not conform to the
policies of the Durham Regional Official Plan regarding
retirement lots. The decision of the Land Division
Committee was appealed by the applicant.
Notice of Hearing Date has been received from the Ontario
Municipal Board - January 7, 1985. Following discussions
with Regional personnel , it is Staff's understanding that
the Region of Durham will be in attendance, at the hearing,
in defence of the Regional Official policies. Accordingly,
it is Staff' s opinion that Staff' s preparing for an
appearance at such a hearing, would not be warranted in
consideration of the Region' s position re; the Official Plan
and policies thereof.
