SUBJECT: APPLICATION FOR REZONING
PENWEST DEVELOPMENT CORPORATION LIMITED
PART LOT 9, CONCESSION 1 , NEWCASTLE

RECOMMENDATION:
It is respectfully recommended that the General Purpose and -.-
Administration Committee recommend to Council the
following:
1 . That Report PD-3-84 be received; and
2. That the attached by-law, being a by-law to
amend By-law 1587, as amended, in respect of
Part of Lot 9, Concession 1 , Town of Newcastle
be approved.

BACKGROUND AND COMMENT:
On November 14, 1983, staff received an application for
rezoning in respect of proposed Plan of Subdivision
18T-76011 , Penwest Development Corporation Limited. The
subject application for rezoning was submitted in order to
satisfy the conditions of draft plan approval as imposed by
the Ministry of Housing and requested by the Town of
Newcastle. The subject application was circulated in
accordance with departmental procedures and the comments
received were similar to, if not the same as those received
during the processing of the subdivision application .
Staff would also note that one written submission had been
received as of the date of writing this report. This
* submission (copy attached) objects not to the rezoning, but
to the location of Street F within the draft approved plan
of subdivision. Staff note that although the subdivision is
draft approved and the road location is in accordance with
the approved Neighbourhood Development Plan , it may be
possible to negotiate with the developer minor readjustments
to the road location. In any event, if the road were
shifted to the east, the only benefit to Mr. Mutton would be
to increase the depth of any lots to be created on his
lands. Staff feel that the road location is appropriate and
that the real issue becomes one of cost sharing. In that
regard, the subdivider would be responsible for a
contribution towards the road construction as part of their
subdivision agreement. In fact, access for Street G would
not be granted to the road unless such financial obligations
were met.
In view of the foregoing comment, and the fact that this is
a matter unrelated to the zoning by-law, staff are

recommending that the rezoning be proceeded with. By copy
of this staff report, we have advised Mr. Mutton that the
concerns related to the road are a matter for negotiation
between himself and Penwest.
As a result of the department' s consideration, staff
* prepared the attached amendment to By-law 1587, as amended,
and in order to expedite the registration of this Plan of
Subdivision, it would be appropriate for Council to approve
same.
