That Report PD-10-84 be received ; and 2. That Council confirm the actions of staff in appealing the Land Division Committee decision on Application No. LD 359/83 to the Ontario Municipal Board. a t�� REPORT NO. : PO-10-84 Page 2 BACKGROUND: On October 21 , 1983, Staff received notification from the Region of Durham Land Division Committee of an application (No. LD 359/83) submitted by 506203 Ontario Limited. The application was to permit the conveyance of a 0.96 hectare (2.37 acre) vacant parcel to meld with an existing recreational vehicle sales dealer fronting onto the east side of Highway 35/115 in Lot 28, Concession 4, Clarke (see attached) . In our comments to the Land Division Committee (attached) , Staff noted that the subject vacant parcel -is zoned "Highway Commercial " and "Agricultural " , and that a retail trailer outlet is listed as a permitted use within the "Highway Commercial " zone, but is not listed as a permitted use in the "Agricultural " zone. Staff recommended approval of the melding of that portion of the vacant parcel zoned "Highway Commercial " directly adjacent and to the east of the travel trailer sales operation, with the approval being conditional upon Site Plan Approval for the expanded trailer sales operation. I Staff further recommended denial of the remaining area subject to the severance application which is zoned "Agricultural ." The Land Division Committee considered the application on November 14, 1983, and approved the conveyance of the land zoned "Highway Commercial " as indicated on the key map attached. As well , the Committee's decision did not include the requirement for Site Plan Approval , as requested by the Town. . . .3 i REPORT NO. : PD-10-84 Page 3 Staff do not feel that the conveyance as approved by the Land Division Committee represents good planning practice, or that the parcel to be severed is appropriate for the proper development of this area. The conveyance as approved differs substantially from that which was originally applied for and therefore should have been recirculated. As well , the requirement for Site Plan Approval was not included as a condition of approval . Staff note that we are presently negotiating with the applicant regarding revisions to the application. However, the appeal should be proceeded with, in the event these negotiations fail . The final date for the submission of appeals on the decision was December 13, 1983. Staff notified the Land Division Committee of intention to appeal on December 8, 1983. Staff are now seeking Council ratification of staff's actions in filing the appeal to the Ontario Municipal Board. If, however, Council does not wish to proceed with an appeal , staff will advise the O.M.B. accordingly. Respectful ] fitted, T. T. A recreational vehicle sales outlet is not listed as a permitted use within this designation. However, Section 16.6.5 of the Plan permits area municipal Councils to zone to permit the expansion or enlargement of existing uses which do not conform to the designations and provisions of the Official Plan. CONFORMITY WITH ZONING BY-LAWS: The subject site is zone HC-Highway Commercial " and "A-Agricultural " by By-law 1592, as amended, of the former Township of Clarke. Retail travel trailer sales are listed as a permitted use within the "Highway Commercial " zone, but are not listed as a permitted use in the "Agricultural " zone. OTHER COMMENTS: The lot on which the existing travel trailer sales outlet is located and to which the applicant proposes to meld the subject site, is zoned "Highway Commercial " . Staff also note that the subject site extends behind the commercial uses adjacent to the existing travel trailer sales operation. i RECOMMENDATIONS: Approval or t at land presently zoned "Highway Commercial " directly adjacent to and to the east of the existing travel trailer sales operation, conditional upon Town approval of . . .2 I I i -2- Site Plans and/or execution of a site plan agreement for the expanded travel trailer sales outlet.
