MEETING OF JANUARY 16, 1964

SUBJECT: EXTENSION OF DRAFT PLAN APPROVAL - 18T-19720
ROMNEY MEAD SUBDIVISION
PART LOTS 29 & 30, CON. 1 , VILLAGE OF NEWCASTLE
EAST WOODBRIDGE DEVELOPMENTS LTD.
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 • That Report PO-19-84 be received, and
2• That Council adopt the following resolution :
"The Council of the Town of Newcastle hereby
requests the Minister of Municipal Affairs and
Housing to extend the draft plan approval for
Subdivision 18T-19720 for a further one year
period to March 29, 1985" ; and
3• That the request in 2 above be forwarded to the
Ministry of Municipal Affairs and Housing and
that East Woodbridge Developments Limited be so
advised.

BACKGROUND AND COMMENT:
* On December 22, 1983, Planning Staff received the attached
notice from the Ministry of Municipal Affairs and Housing
advising approval of Subdivision 18T-19720 will lapse on
March 30, 1984. The subdividers, East Woodbridge
Developments Ltd. , have also been advised of the lapsing of
draft approval by the Ministry.
In that regard, staff have reviewed the possibility of

extending draft approval for an additional one (1 ) year
period. We note that draft approval has been extended on
several occasions, the most recent had been given on March
7, 1983, at which time staff indicated to Council that there
were financial obligations owing by the subdividers. Staff
further indicated in that report submitted to the meeting of
March 7, 1983, that should the subdividers not submit
payment for the outstanding monies owing to the Town , staff
would object to a further extension of draft approval .
However, discussions with Treasury indicate that the
subdividers have made the necessary payments to the Town.
Should there be any additional monies owing, ie. engineering
costs, etc. , the Town of Newcastle may recover such amounts
through the subdivision agreement for the subject
development.
Therefore, in consideration of the foregoing, staff would
have no objection to the approval of a one (1 ) year

extension in draft plan approval . Upon expiry of this draft
plan approval , the plan would subsequently be reviewed again
in 1985.

Subject: Lapsing of Draft Approval
File 18T-19720
Municipality: Town of Newcastle
Dear Sirs:
Draft approval of this plan will lapse on March 30, 1984.
As you may know, it is your responsibility to request
an extension, with reasons , well in advance of the
lapsing date.
Please Note: We have recently changed our procedures
for—extensions to draft approval for plans of subdivisions
in the Regional Municipality of Durham.
In the past, we required you to secure a council
resolution in support of an extension before we would
grant it. This procedure involved considerable amounts
of time for owners , staff and council, with few concerns
being raised. We have therefore tried to simplify the
procedure.
Your request for extension, with reasons , is now to be
submitted directly to this office before the lapsing
date , with copies to the municipality and regional
planning department for information.
The local municipality has been supplied with a list
of draft approved plans and their lapsing dates in
order to undertake an ongoing review. If, for some
reason, council feels and extension is unadvisable,
we have asked them to inform us directly before the
lapsing date. If we do not hear from them, we assume
no objection and will process the extension request.
A similar procedure has also been set up with the
regional planning department.
We hope this procedure will reduce the amount of time

Your co-operation with this new procedure would
be appreciated. Please remember, that once draft
approval has lapsed, it cannot be reinstated. A
new application would have to be submitted to the
Regional Municipality of Durham.
