SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF DECEMBER 14, 1983
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 • That Report PD-2.0-84 and the minutes of the
Committee of Adjustment meeting of December 14,
1983 be received for information .
BACKGROUND AND COMMENT:
For. the information of the General Purpose and
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of December 14, 1983. This list includes the file
number, applicant 's name, site location, type of variance
requested, Official Plan Conformity, By-law Conformity,
staff's comments on the applications , and the Committee of
Adjustment 's decision.

APPLICATIONS:
A 88/83 - Toni K. & Janette Horsley, Lot 29, Concession 2, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with an
existing single family dwelling, having a lot frontage of 217 feet
(66. 1 m) and an area of 1 .33 acres ( .53 ha) , whereas the by-law
requires a frontage of 100.5 m and an area of 2 ha.
Mr. Horsley appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Muir,
"THAT as the requested variance does not offend i
the intent of the Official Plan or Zoning By-law,
permission is GRANTED to continue the use of a
legal non-conforming single family dwelling on a
lot with a frontage of 217 feet (66. 1 m) and an
area of 1 .33 acres ( .53 ha) . "

A 91/83 - Edward Holyome, Lot 35, Concession 4, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to expand a legal non-conforming use
by the construction of a porch to the existing single family
dwelling.
No person appeared in support of or in opposition to this application.
Moved by Mr. Muir, seconded by Mr. Murdoch,
"THAT as the dwelling is in existance the variance
would not offend the intent of the Zoning By-law or
Official Plan and as the application is for a closed
in porch,' the variance is considered minor in nature
and permission is GRANTED to construct a porch to the
existing legal non-conforming use. This variance
is conditional upon the approval of C.L.O.C.A."

order to permit the applicant to

instead of the required 8 ft. side yard.

"THAT as the variance would not offend the intent of
the Official Plan or Zoning By-law and this variance
is considered minor in nature as it is recognizing an
existing non-conforming side yard, permission is GRANTED
to create a lot with an existing single family dwelling
having a side yard of .9 m (3 ft. )".

2.78 m, instead of the required 15 m side yard.

order to permit the applicant to construct a 1050 sq. ft. single

bay window projecting into this rear yard, and exceeding the floor
area ratio, whereas the by-law requires a 1.500 sq. ft. single
family dwelling and a rear yard of 25 feet.
