SUBJECT: REOUEST TO REZONE THE KIRBY SCHOOL/MUSEUM
PART OF LOT 25, CONCESSION 7, TWP. OF CLARKE
FILE NO: 3-6-02.0-02 (Property Location)
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following :
1 • That Report PD-21-84 be received; and
2• That Mr. Derek Barnett, Chairman of the Clarke
Museum and Archives, be advised that the Town
of Newcastle will include the zoning of the
subject property recognizing the existing use
as a Museum within an appropriate zoning
classification in the Town of Newcastle
Comprehensive Zoning By-law.

BACKGROUND:
On December 13, 1983 Planning Staff received a copy of the
* attached letter submitted by Mr. Derek Barnett regarding a
rezoning of the Kirby School property located in Part of Lot
25, Concession 7, Clarke. In reviewing this matter staff
note that this has been an outstanding item since 1981 , at
such time as the Ministry of Transportation and
Communications had undertaken the reconstruction of Highway
35/115. Through previous negotiations between the Clarke
Museum and Archives, the Town of Newcastle, and the Ministry
of Transportation and Communications, certain requests were
brought forward by the Museum Board, one of which was that
the Town rezone the subject site in order to recognize and
protect the continued use of the Museum site in the future.
Subsequent to these negotiations, no further action has
appeared to have been taken by the parties involved.
COMMENTS:
Staff have reviewed the subject request submitted by Mr.
Barnett and note that at the present time the subject
property is zoned "Agriculture" by the Clarke Zoning By-law.
The use of the property for the purpose of a museum is not
specifically permitted under this zoning classification.
However, public uses are permitted in any zone.
Due to the fact that this year staff will be introducing the
Comprehensive Zoning By-law for the Town of Newcastle, staff !
would suggest that the new Comprehensive Zoning By-law
address this use specificially with the relative By-law
requirements.

As a result of the above, staff have no objection to
recognizing the Kirby School /Museum as a specifically
permitted use within the Comprehensive Zoning By-law for the
Town of Newcastle. Mr. Derek Barnett of the Clarke Museum
and Archives will be further advised at such time as staff
has considered an appropriate zoning classification for the
property.
