That Report PD-46-84 be received; and * 2, That the attached by-law amending By-law 83-95, as amended, be approved and forwarded to the Ontario Municipal Board; and 3. That a copy of the attached by- law be forwarded to Mr. R.B. LeGresley for his information ; and 4. That By-law 83-120 be circulated in accordance with the requirements of the Ontario Municipal Board. . . .2 Y REPORT NO. : PD-46-84 Page 2 BACKGROUND AND COMMENT: On June 27, 1983, the Council of the Town of Newcastle passed By-law 83-95 to rezone certain lands within the Bondhead area to permit residential infilling on municipal water and private waste disposal systems. In response to a number of objections raised during the course of our circulation of By-law 83-95, the Town enacted By-law 83-120 on September 12, 1983 in order to address the concerns identified by the objectors. Inasmuch as all of the objections were not withdrawn, an Ontario Municipal Boar hearing was convened on December 12, 1983. At that time an area resident, Mr. LeGresley appeared, and although not one of the original objectors, identified for the benefit of the board, a number of concerns related to the rezoning of lands under his ownership. As a result of his representation, the Board member felt that it would be premature to rezone Mr. LeGresley's lands, and approved By-law 83-95 subject to the following provisions : 1 . That the By-law be amended to delete lands owned by Mr. R.B. LeGresley; and 2. That By-law 83-120 be circulated in accordance with the requirements of the Planning Act, inasmuch as they were unwilling to dispense with this circulation. This report is intended to address the Board decision, and the purpose of the attached by-law is to delete those lands under the ownership of Mr. LeGresley. . . .3 REPORT NO. : PD-46-84 Page 3 Similarly, by memorandum dated January 31 , 1984, the Clerk has been requested to initiate the circulation of By-law 83-12.0. We note however, that should there be any objections received to By-law 83-12.0, the Ontario Municipal Board intends to reconvene the hearing in respect of this matter. It is therefore respectfully recommended that the Committee recommend to Council that the attached By-law be approved and forwarded to the Ontario Municipal Board in accordance with the decision of the Board dated December 12, 1983.
