SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT
APPLICATIONS FOR MEETING OF JANUARY 25, 1984
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the

following :
1 . That Report PD-49-84 and the minutes of the
Committee of Adjustment meeting of January 25,
1984 be received for information.

For the information of the General Purpose and �
* Administration Committee, staff have prepared the attached
list of applications to the Committee of Adjustment for the
meeting of January 25, 1984. This list includes the file
number, applicant' s name, site location, type of variance
requested, staff's comments on the applications, and the
Committee of Adjustment 's decision, i

APPLICATIONS:
A 1/84 - Milton Bartley, Part Lot 18, Concession 2, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with a
frontage of 31 .544 m and an area of .186 ha, instead of the re-
quired 45.5 m .frontage and area of .348 ha, with a single family
dwelling having a side yard of 5 m, instead of the required 6 m
side yard.
Mr. Ken Polley appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Reicheld,
"THAT as the variance would not offend the intent
of the Official Plan or Zoning By-law and would
recognize the existing non-conformities, permission
is GRANTED to continue the use of a lot with a
frontage of 31 .544 m and an area of .186 ha with
an existing single family dwelling having a side
yard of 5 m."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with a
frontage of 94.94 ft. , instead of the required 150 ft. frontage and
an area of 15,721 sq. ft. , instead of the required 1 acre, with an
existing single family dwelling having side yards of 20.14 ft. and
18.31 ft. , instead of the required 25 ft. side yards and maintaining
an existing non-conforming set back with an accessory building
having a side yard of .08 ft. and a rear yard of .08 ft. , instead
of the required 4 ft. rear and side yard.
Mr. H. Valckz and Mr. J. Wilbur appeared in support of this
application. No other person appeared in support of or in opposition
to this application.
Moved by Mrs. Payne, seconded by Mr. Rehder,
"THAT as the varinace would not offend the intent
of the Zoning By-law or Official Plan and would
recognize the existing non-conformities, per-
mission is GRANTED to continue the use of a lot
with a frontage of 94.04 ft. and an area of
15,721 sq. ft. with an existing single family
dwelling having side yards of 20. 14 ft. and
18.31 ft. and maintaining a non-conforming set
back with an accessory building having a side
yard of .08 ft. and rear yard of .08 ft."

Application was made for relief from zoning by-law requirements in
order to permit the applicant to continue the use of a lot with an
existing single family dwelling having a side yard of 7.28 m,
instead of the required 7.5 m side yard.
Mrs. Isert appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Reicheld, seconded by Mr. Muir,
"THAT as the variance would not offend the intent of
the Zoning By-law or Official Plan and would recognize
the existing non-conformities, permission is GRANTED
to continue the use of a lot with an existing single
family dwelling having a side yard of 7.28 m. "

A 4/84 - Natomas of Canada Ltd. (DX OIL) , Part Lot 28, Conc. 3, Clarke.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to install a vertical propane tank
in the front yard, instead of being located wholly in the rear yard.
Mr. Brian Mack appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Reicheld,
"THAT as the proposed location of the vertical
propane tank in the front yard will make the
facility more accessible and will increase its
visibility for travellers on Highway 35/115 and
as the site appears to conform with the provisions
of the Official Plan, permission is GRANTED to
install the vertical propane tank in the front yard,
instead of entirely in the rear yard. This approval
is conditional upon all on-site and off-site signs
being brought into compliance with the Town Sign By-
laws. "

Moved by Mr. Murdoch, seconded by Mr. Muir,
"THAT the minutes of the last meeting be approved
as circulated. "

Appeal date for the foregoing applications is February 24, 1984.
Next meeting of the Committee of Adjustment is February 15, 1984.
