BACKGROUND AND COMMENT:
The Ontario Building Code is for new construction and was
not written with a view to the impact on renovations to
existing buildings. Some Code requirements are impractical
when applied to older buildings that are being restored or
renovated to residential use.
In 1980, a Committee composed of representatives from the
Ministries of Consumer & Commercial Relations , Municipal
Affairs and Housing, and the Solicitor General was
established to review the life safety requirements of the
Building Code so as to develop suitable alternatives that
could be used when renovating existing buildings.
Subsequently, an Advisory Committee, a Working Commitee and
three Task Groups , with co-operation of Municipal , building
industry, professional associations, and other government
agencies , were established to develop guidelines for use in
the renovations of existing buildings for residential use.
The aim was to provide reasonable flexibility in the area of
minimum life safety and facilitate more effective
renovations for residential use.
The Committees and Task Groups produced a set of Compliance
Alternatives for use in the renovation of existing building
for residential use, and the Advisory Committee recommended
to the government, that the Guidelines become legislation as
part of the Building Code.
An Act to amend the Building Code was presented to the
Legislative Assembly was passed and on December 16, 1983,
received royal assent.

The Guidelines as proposed to become Part XI - Residential
Renovations to the Ontario Building Code, will permit all
existing buildings, which have been legally occupied and
used for at least five years, to qualify for compliance with
this Part.
However, the use of Part XI of the Code is limited to what
is referred to as Group 'C' - Residential Occupancies
classified as houses , boarding and lodging houses , or
apartment buildings, and to other buildings intended to be
used for one or another of such occupancy classifications.
It is recognized that Heritage Buildings , because of their
unique characteristics , may require special consideration
and alternative measures may be suggested in addition to the
Compliance Alternatives listed in Part XI Guidelines. The
Chief Official is permitted to exercise some discretion
where due to conditions peculiar to the building, such as
type and/or vintage of construction , lot line limitation ,
room configurations, dimensions of means of egress, archaic
materials, and assemblies etc. , compliance with the Code
cannot be achieved.
The proposed Part XI , Residential Renvoations deals only
with residential uses , but the enabling legislation, Bill
147, an Act to amend the Building Code Act includes all
buildings. It is possible that after some experience with
Part XI, that in the long term, there may be further Code
amendments which would include other Heritage Buildings.

An Act to amend the Building Code Act
HER MAJESTY, by and with the advice and consent of the
Legislative Assembly of the Province of (>ntario, enacts as
follows:
1. Subsection 19 (1) of the Building Code Act, being chapters 19(1)•
51 of the Revised Statutes of Ontario, 1980, is amended by

ing thereto the l'ollowing clauses:
(oa) permitting chief officials, subject to such conditions
as are set out in the regulations, to allow the use of
materials, techniques and designs that are other than
! those prescribed by the regulations with respect to
construction in relation to an existing buil(ling;
(ob) requiring the alteration of any part or parts of an
existing building where construction in relation to
the building affects the part or parts.
2. This Act comes into force on the day it receives Royal "11111101ce-
Assent.
3. The short title of this Act is the Building Code Amend- 'Short litre
ff ureut Act, 1983.
