HomeMy WebLinkAboutPD-53-84 CORPORATION OF THE TOWN OF NEWCASTLE PLANNING AND DEVELOPMENT DEPARTMENT T.T.EDWARDS,M.C.I.P.,Director HAMPTON,ONTARIO LOB 1JO TEL.(416)263.2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF FEBRUARY 2.0, 1984 REPORT NO. : PD-53-84 SUBJECT: APPLICATION FOR REZONING - SRI INAI INTERNATIONAL INCORPORATED - Part Lot 7, Concession 2, Darlington - File: DEV 83-40 RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following : 1 . That Report PD-53-84 be received ; and * 2. That the attached by-law to amend Zoning By-law 2111 , as amended, be forwarded to Council at such time as the applicant has satisfied the Town of Newcastle Works Department respecting the future dedication of the appropriate road widenings and site triangle on the subject property. N Lb� REPORT NO. : PO-53-84 Page 2 BACKGROUND: On December 16, 1983 the Planning Department received an application submitted on behalf Sri Inai International Incorporated to rezone a 106.73 acre (43.2.2 hectare) parcel of land in Part Lot 7, Concession 2, former Township of * Darlington (see attached map) . The purpose of the rezoning would be to permit the development of a private school with dormitory facilities on the site of the former Pine Ridge Training School . It is anticipated that the initial enrollment will be one hundred and fifty (150) students in June , 1984, with an additional one hundred (100) students being added in September, 1984. It is hoped that the future enrollment will approach four hundred (400) students plus the required academic and supporting staff. The proposed private school is to offer Grade 13 course material to Malaysian students to prepare them academically and culturally for entrance into North American colleges and universities. COMMENTS: In accordance with departmental procedures , the proposed rezoning application was circulated to all concerned Town departments and outside agencies for their comments and/or concerns. It was the Regional staff's considered opinion that the proposed private college did not qualify as a "Institutional use" as envisioned within the Durham Regional Official Plan. Accordingly, the applicant was so advised and proceeded to make an application to amend the Durham Regional Official Plan. The General Purpose and Administration Committee, at their meeting of January 16, 1984 recommended to Council that REPORT NO. : PD-53-84 Page 3 the Region of Durham be advised that the Town of Newcastle has no objections to an Official Plan amendment thereby permitting a private school with dormitory facilities. Council at their meeting of January 23, 1984, endorsed said resolution and forwarded same to the Region of Durham. Staff would note for Committee 's information that Amendment No. 106 to the Durham Regional Official Plan was forwarded to the Ministry of Municipal Affairs and Housing on February 6, 1984. The Town of Newcastle Works Department upon reviewing the application, indicated no major objections to the proposal subject to the following : 1 . That the 3.048m (10 foot) road widening for the entire frontage on to Shaw Road being dedicated to the Town. 2. That a 3.048m (10 foot) road widening for the entire frontage on to Concession Street being dedicated to the Town. 3. A 9.144m (30 foot) by 24.38m (80 foot) site triangle at the intersection of Concession Street and Shaw Road be dedicated to the Town. Upon receipt of the above-noted comments, Staff contacted Mr. Barry Knoll , Totten, Sims, Hubicki Associates, informing him of the Works Department' s comments. Mr. Knoll indicated to Staff that the request would not appear to be detrimental to the present project and would relay same to the appropriate parties. Staff indicated to Mr. Knoll that in similar circumstances , the dedicating of any road widenings/ site triangles was required prior to the forwarding of By-law amendment to Council . Staff notes that the property in question is still under the ownership of the Ministry of Government Services, and that the fulfilling of this requirement prior to the sale to the new owners creates a . . .4 IV -� > REPORT NO. : PO-53-84 Page 4 timing problem. Staff would suggest that Council give consideration to the applicants providing the Town of Newcastle Works Department with a solicitor's letter of undertaking indicating that the appropriate road widenings and site triangle will be dedicated to the Town of Newcastle free and clear of all encumbrances upon the completion of the sale of the property to the new owners . In reviewing the application it was noted that a large portion of the property lies within the fill and construction - flood plain limits of Soper Creek, as shown on the Central Lake Ontario Conservation Authority' s floodline mapping. The Conservation Authority noted within their comments that there are two structures presently situated within the limits of the Regional floodlines - Building No. 16 being the pump house, and Building No. 34 being the sewage pump house. Furthermore, it is noted that any development within the floodprone area of the site will require the prior approval of .the Conservation Authority. The site currently accommodates parking for a total of twenty (20) cars in two areas. One lot to the west of the ring road in front of the Administration Building accommodating eight (8) cars, and the other lot located to the east of the ring road between the Victoria house and Kiwanis house. Discussions with Totten, Sims, Nubicki staff have indicated that a teacher/student ratio of one (1 ) to thirty (30) will be followed in determining class sizes. Potentially a maximum of four hundred (400) students would reflect the need for fourteen (14) teachers. The intentions of the school as understood by staff, will be to provide the necessary transportation i .e, mini vans, buses for the Malaysian students when outings are required. Staff would . ..5 i REPORT NO. : PD-53-84 Page 5 note, at this time the anticipated student body of one hundred and fifty (150) students and expansions of two hundred and fifty (250) in September of 1984 require minimum of nine (9) teachers. It is anticipated that additional parking may be required in the future and would be best accommodated at such time. Staff furthermore notes, that any new facilities proposed as noted in the Official Plan amendment , may require the entering into of a Site Plan agreement with the Town, pursuant to the provisions of the Planning Act. Such an agreement may generally include provisions for parking, demolition of existing structures, servicing and landscaping. In consideration of the above, staff have no objections to the approval of the application as submitted, to permit the use of the site for a private school with dormitory facilities.
