A.E. KING PART LOT 33, CONCESSION 18TF83006 TOWNSHIP OF DARLINGT O PROPOSED REDLINE REVISIONS RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-58-84 be received; and 2. That the Region of Durham be advised further to the recommendations endorsed by Council on November 14, 1983 respecting Plan 18T-83006, that the Town of Newcastle has no objections to the approval of the revised Plan of Subdivision 18T-83006 as further revised in red and subject * to the conditions contained in Attachment No. 1 to this report; and 3. That a copy of Report PD-58-84 be forwarded to the Region of Durham for information. . . .2 REPORT NO. : PO-58-84 Page 2 Council at their meeting held on November 14, 1983, endorsed the following reecommendations and notified the Region of Durham of said recommendations by letter of November 15, 1983. "Report PD-142-83 be received and the recommendations in Staff Report PD-121 -83 be approved with the following amendment : Paragraph 5 of Attachment No. 1 to Staff Report PD-121-83 is hereby deleted in its entirety and replaced with the following new approved Paragraph No. 5. That Block 60 be included as part of Lots 40 to 44 inclusive, and that a 3 metre wide walkway be provided between Lots 44 and 45." Subsequent thereto, a request was received through the Region of Durham Planning Department requesting the Town' s consideration and recommendations pertaining to the revising of the draft plan. The revisions proposed would result in creation of two additional residential lots on the east side of Buckingham Drive and the relocation of the walkway to the public open space - valley lands to the south of the development. In addition, the request included the replotting of Lots 38 and 39 thereby fronting on to Given Road. Upon receiving the application, staff circulated same to the appropriate Town Departments requesting their comments and/or concerns pertaining to the changes proposed. The Works Department expressed a concern in the changes pertaining to Lots 38 and 39 and advised that access from Buckingham Drive would be more desirable. Staff, by letter, advised the applicant of the Works Department concerns noting that he may wish to contact the Works Department through his Engineering Firm - D.G. Biddle and Associates to discuss and resolve the question of access. . . .3 (c REPORT NO. : PD-58-84 Page 3 Further to the discussions with D.G. Biddle and Associates, the Works Department advises that the supporting information prepared and provided by D.G. Biddle and Associates satisfactorily answers their concerns and they would therefore, have no objections to the revisions as requested. Furthermore, it is noted for the Committee's information that in addition to the replotting of Lots 38 and 39, staff would have no objections to the similar replotting of Lots 32 and 33 thereby providing access on to Given Road. This reorientation of the four (4) lots would provide additional continuity to the development on Given Road between Highway No. 2 and Nash Road, bearing in mind, the fact that the lots within the plan of Subdivision 18T-81015 (on the west side of Given Road) also provide direct access on to Given Road . That this approval shall apply to a draft plan of subdivision dated March 29, 1983, and revised in accordance with the attached redline revision, showing sixty-one (61 ) single family residential lots and four (4) blocks. 2. That the Developer agrees to enter into an agreement for the upgrading of the road allowance known as Nash Road and Given Road adjacent to the subdivision. 3. That all road allowances in this draft plan be dedicated as public highways. 4. That the streets in the plan be named to the satisfaction of the Town of Newcastle. 5. That the developer agrees to pay to the Town of Newcastle five percent (5%) cash-in-lieu of parkland . 6. That all 0.3 metre (1 .0 foot) reserves and road widenings shown on the revised plan be dedicated free and clear of all encumberances to the Town of Newcastle. 7. That prior to final approval , the applicant shall submit to the Central Lake Ontario Conservation Authority, the following information for approval : (a) details of implementing sediment control for all phases of development activity. . ..2 ATTACHMENT NO. 1 TO REPORT PO-58-84 Page 2 (b) engineering evidence indicating that the rate of post development rufoff into the receiving water course shall not exceed the rate of pre-development runoff for storms of five (5) year frequency and greater, in accordance with the recommendations of the Courtice Storm Water Management Study. 8. That the Owner shall enter into a Subdivision Agreement with the Town of Newcastle to include, in addition to the Town' s usual requirements, the following provisions. The Owner agrees : (a) to satisfy the requirements of the Central Lake Ontario Conservation Authority relative to the development of the subject lands; (b) to satisfy all requirements of the Town of Newcastle financial and otherwise , including but not limited to the management of storm water drainage and the reconstruction of abutting roads ; (c) to design and construct all works in accordance with the Town of Newcastle Design Criteria. 9. That the necessary amendment to By-law 2111 , as amended, of the former Township of Darlington, now in the Town of Newcastle, be approved and in effect. 10. That the Owner agrees in writing, to satisfy all requirements, financial and otherwise, of the Region of Durham.
